第一屆資深中央民意代表自願退職條例

第一屆資深中央民意代表的自願退職，依本條例辦理。

各該民意機關 պետք separately budget for the costs needed for retirement compensation.

A person claiming retirement compensation must submit two copies of the prescribed fact form and attach supporting documents.

符合列舉情形之一者，會喪失領受退職酬勞金的權利。

If either listed condition applies, the person’s right to receive the monthly retirement pay is suspended until the cause ends.

請領退職酬勞金的權利，原則上自退職次月起算，三年不行使就消滅；如因不可抗力而不能行使，時效中斷，並在事由終止後重新起算。

領受月退職酬勞金的人死亡時，應發給撫慰金；通常由其遺族具領。

The right to claim retirement remuneration may not be attached, assigned, or used as security.

本條例自公布日施行。

本條定義「第一屆資深中央民意代表」的範圍。

前條人員可以依本條例規定，向各該民意機關申請自願退職。

符合特定情形的人員，視為自願退職；通知後次月起6個月內未申請退職的，由各該民意機關代辦。

依本條例退職人員可依年資領取退職酬勞金；未滿十五年者領一次金，滿十五年者可在一次金、月金或兩者各半之間擇一。

Certain retired personnel may combine prior military/civil/public service seniority, but only if they can prove it and have not already received specified retirement or severance payments. National Assembly members who also served in military/civil/public service must count overlapping seniority only once when handling retirement or related separation.

Certain people who re-enter public service do not have to repay retirement compensation or pension already received, and some prior service years are not counted again.

各該民意機關負責辦理退職酬勞金的給與。

月退職酬勞金從退職後的次月開始發給。
