省參議員選舉條例

符合年齡、居住和考試/檢覈條件的中華民國公民，可以被選為省參議員。

投票時，除了投票人和投票所職員外，其他人不得進入投票場所。

Ballot boxes must be displayed on site and then sealed; the outer layer must be tightly locked after voting ends.

投票人領取選舉票時，應在選舉人名簿本人姓名下簽字或蓋章。

Voting is to be conducted by secret ballot.

投票人在投票場所內，不得與他人交談；但就投票方法可以向事務人員詢問。

投票結束後，監察員應監視開票。

檢查票數時，應與到場投票人名簿核對，以查明有無錯誤。

各縣市政府投票所應將選舉結果連同選舉票報送省政府查核。

省政府查核選舉結果時，選舉監督或其代表應到場監視。

A ballot is invalid if it is not written in the required form, includes other writing, is unclear and unreadable, or is written on a ballot that should not have been issued.

列舉的人員被停止被選舉權；但第一款的限制不適用於各級學校校長。

A candidate is elected by receiving more than half of the votes cast by those eligible to attend. If no one is elected, a new election must be held, and the candidate with the most votes wins.

候補當選人按得票次多數決定；名額與當選人相同；票數相同時以抽籤決定。

省政府應公告當選人及候補當選人名單，並通知各當選人。

當選人接到省政府通知後，必須在七日內答復是否願意應選。

An election is invalid if either specified unlawful conduct occurred and the court judgment is final.

If any listed circumstance exists, the election is invalid.

If an election is declared invalid by a court judgment, a new election must be held within 10 days.

Certain voters or unsuccessful candidates may file a lawsuit about election fraud or ineligibility, but only within 7 days after the election result is disclosed.

Election lawsuits are heard before other types of lawsuits and are concluded at first instance.

本條例的解釋權屬於選舉監督。

省參議員選舉由內政部部長擔任選舉監督。

省政府 must report election results and related details to the election supervisor within 10 days after the election, and keep valid and invalid ballots for 6 months. The election supervisor must then report the names of elected and alternate elected persons to the Executive Yuan for record.

This provision says the effective date of the条例 will be set by order.

When the provincial government compiles the voter register, it must also compile the candidate register.

省政府負責辦理省參議員選舉事務。

省政府決定省參議員選舉日期，並須在一個月前公告。

省政府須在選舉一個月前公告全省應出的省參議員名額，並製作選舉票分發各縣市領取。

省參議員由縣市參議會選舉，並以縣市政府作為投票所，採集會方式，且須有縣市參議員過半數出席投票。

縣市政府職員負責省參議員選舉投票開票事務；出席代表要互推三人至五人擔任監察員在場監視。
