軍人及其家屬優待條例

This provision states that the条例 was enacted under Article 50 of the Enforcement Act of the Military Service Law.

Creditors may not seek compulsory enforcement against property necessary for the livelihood of a soldier’s family while the soldier is serving during a mobilization call-up period.

Called-up soldiers may apply to the township office for help cultivating their land while serving, if their family is truly unable to farm it; the Ministry of the Interior sets the procedure.

This provision is deleted.

If an agency needs a replacement worker for a conscripted employee, it must first hire a family member who has the required job qualifications and ability.

Family members of active-duty military personnel may get priority when buying daily necessities ration goods under the law.

現役軍人及其家屬在婚嫁喪葬無力舉辦時，當地鄉鎮公所或兵役協會可酌予協助。

地方政府 must arrange burial and may provide compensation or support when an active-duty soldier’s family member is killed by the enemy during combat.

政府機關、公立學校或公營事業機構在任用新進人員時，若資格相等且對象是後備軍人，應優先登記錄用。

Reserve military personnel whose studies or skills were set back by service should be given an opportunity for remedial training after they return to school or work, or enter school or employment.

後備軍人在就業前如果不能維持生活，社會行政機關或兵役協會可以視財力給予救助。

後備軍人承租、承領或承墾公地時，在與其他申請人條件相同的情況下，應享有優先權。

後備軍人轉任公職時，其考試與比敘事項另由法律規定。

The institution employing a reserve military personnel member who has transferred to public office may keep that person’s position when staffing is reduced or the organization is reorganized.

中央或地方在舉行重要慶典時，可以特設榮譽席，並邀請特定人員參加慶祝，以示崇敬。

現役軍人如果失去身分或被通緝，第三章規定的優待就停止。

Military personnel who are legally retired from service or exempted from service are to receive preferential treatment handled by the Veterans Affairs commission.

If the benefits in this regulation must be ranked, they are applied first to active-duty military personnel, then their family members, then reserve military personnel; if people are in the same category, priority goes to those who fought during service, then those with longer service, then those with greater financial hardship.
