兒童福利法

This law is enacted to protect children's physical and mental health, promote normal development, and safeguard children's welfare.

各級主管機關為協調、研究、審議、諮詢及推動兒童福利，應設兒童福利促進委員會；其組織規程由中央主管機關定之。

政府應培養兒童福利專業人員，並定期舉辦職前訓練與在職訓練；其資格由中央主管機關決定。

This provision lists the sources of children’s welfare funding.

縣（市）政府應辦理列舉的兒童福利措施。

前條第四款的家庭生活扶助或醫療補助，只限於符合列舉情形之一的人。

When a child faces immediate danger to life, body, or liberty, the child must receive emergency protection, placement, or another necessary measure.

保護安置時要立即通知當地地方法院；一般不得超過72小時，必要時可聲請法院裁定繼續安置並得延長一次。

符合條件的兒童，可由父母、監護人等向當地主管機關申請安置或輔助；主管機關可安排寄養或機構收容，寄養家庭與收容機構應提供必要服務，孩子在特定情況下仍可返回家庭。

特定兒童福利相關人員知悉兒童有法定情形或受傷害時，應在24小時內向當地主管機關報告；報告人的身分資料也應保密。

為保護、安置、訪視、調查或輔導兒童或其家庭的人，應建立個案資料；因職務知悉的秘密、隱私及相關文書，應保密，沒有正當理由不得洩漏或公開。

This provision defines “child” as a person under 12, requires the birth attendant to report birth information to household registration and health authorities within 10 days, and allows a disabled child’s parents, adoptive parents, or guardian to apply to the police for fingerprint records.

中央主管機關應會同目的事業主管機關訂定獎勵辦法，鼓勵公民營機構設置育嬰室、托兒所等兒童福利設施，並推動對兒童與孕婦的優待措施。

Children and pregnant women should be given priority care, and public/private enterprises in transport, health, and medical services must set up and implement priority-care measures.

縣（市）主管機關應自行設立，或鼓勵民間辦理，列出的兒童福利機構。

Child welfare institutions must use professional staff for their work, and the rules on their pay and benefits are to be set separately. The central and local competent authorities set the establishment standards and rules, and local authorities must report them to the central competent authority for record.

私人或團體辦理兒童福利機構，原則上要向主管機關申請立案，並在許可立案後六個月內辦理財團法人登記；接受捐助時還要公開徵信，且不得作營利或不當宣傳。

任何人不得對兒童從事遺棄、虐待、剝削、強迫婚嫁、販賣、猥褻、提供危險物品等列舉行為。

法院審理兒童收養時，應以兒童最佳利益為核心，並在特定情況下尊重滿七歲兒童的意願。

法院認可收養後，收養效力依情形回溯到書面契約成立、聲請時，或開始共同生活時。

If adoptive parents commit certain listed acts against an adopted child, an interested person or the competent authority may ask the court to terminate the adoption.

Parents, adoptive parents, or guardians must take responsibility for the care of their children. Government bodies and related public or private institutions and organizations must help them protect children’s health and normal development, and provide social services and measures for children who need guidance, discipline, protection, rehabilitation, or disability-related support.

父母、養父母、監護人或其他實際照顧兒童之人，必須禁止兒童從事不正當或危險的工作。

家長、養父母、監護人或其他實際照顧兒童的人，應禁止兒童吸菸、飲酒、嚼檳榔、施用毒品及其他有害身心健康的物質；任何人都不得把這些物質供應給兒童。

During pregnancy, a woman should not smoke, drink alcohol, chew betel nut, use drugs, or do other harmful acts affecting fetal development; other people must not encourage or force her to do such acts.

Adults responsible for a child must keep the child out of specified entertainment and vice-related venues, venue staff must refuse entry, and no one may use, employ, or induce a child to do the listed work.

父母、養父母、監護人或其他實際照顧兒童的人，不得讓兒童單獨處在容易發生危險或傷害的環境；對六歲以下或需要特別看護的兒童，也不得讓其單獨留著，或交由不適當的人照顧。

Anyone may notify local authorities, police, or child welfare institutions when certain violations or child welfare situations are found; police and child welfare institutions must report to the competent authority within 24 hours, and the competent authority’s staff must submit an investigation report within 4 days.

主管機關必要時可以自行或委託相關機關／兒童福利機構進行訪視、調查；相關人員應配合並提供資料。

主管機關要把符合條件的兒童安置並觀察輔導；必要時可送專門機構做輔導教育，並對患性病的兒童免費強制治療。

少年法庭和主管機關可在特定情況下將兒童交由主管機關、兒童福利機構、寄養家庭或育幼院安置、收容；期間應對兒童施予輔導教育。

前二條安置費用可以由扶養義務人負擔；不支付時，主管機關可聲請法院裁定後強制執行；無支付能力時，改由兒童福利經費支付。

政府和公私立兒童福利機構在處理兒童相關事務時，應優先考慮兒童的最佳利益；兒童的保護與救助也應優先受理。

符合條件時，相關親屬、主管機關、兒童福利機構或其他利害關係人可向法院聲請停止父母、養父母或監護人的親權／監護權並改選監護人；養父母案件也可聲請終止收養關係。

父母離婚時，法院可以依職權或依聲請，為子女利益決定或變更監護人、監護方式，以及扶養費用負擔方式；法院在此之前要先做必要調查，並可要求主管機關或兒童福利機構協助。

政府應按需要，為發展遲緩及身心不健全的特殊兒童提供早期療育、醫療與就學方面的特殊照顧。

對兒童犯罪的人，刑罰可以加重到二分之一；但如果該罪已另有針對兒童被害人的特別處罰規定，就不適用。

違反第二條第二項、第二十六條或第三十條規定的人，會被處以罰鍰；後一種情形還會公告姓名。

Parents, adoptive parents, guardians, or other actual caregivers of a child can be fined and have their names announced if they seriously violate Article 31(1), knowingly fail to stop a child from working in an Article 33(1) place, or violate Article 33(1) or (2).

This article fines people who exploit children for labor or sexual transactions, and requires the competent authority to provide counseling and education for children involved in sexual transactions.

向兒童供應菸、酒或檳榔，或違反第33條第3項、第4項者，會被處罰鍰；情節嚴重或警告後仍未改善者，主管機關還可命停業、歇業，或移請事業主管機關吊銷執照。

主管機關應命符合條件的照顧兒童者接受至少4小時的親職教育輔導；有正當理由者可申請延期。

Violations of Article 18 are fined NT$6,000 to NT$30,000. Certain child-related persons who violate Article 36(2) without justifiable reason are fined NT$3,000 to NT$30,000, and the fine may be imposed repeatedly until they cooperate or provide the relevant information.

When a child’s rights are unlawfully infringed, the government must provide appropriate assistance and protection.

兒童福利機構違反前述規定、拒不配合安置、或拒不停辦時，主管機關可命停辦、連續處罰，並可處罰鍰；情節更嚴重時，還可處行為人徒刑、拘役或罰金。

如果依本法應受處罰的人有犯罪嫌疑，還要移送司法機關處理。

If a fine imposed under this Act is overdue and unpaid, it is sent to court for compulsory enforcement.

中央主管機關負責訂定本法施行細則。

This law takes effect on the date it is promulgated.

This article assigns child welfare competent authorities and requires them to set up dedicated child welfare units, while related justice, education, and health units must cooperate when the business is involved.
