敬老福利生活津貼暫行條例

This provision states that the law is enacted to support older people’s living needs and improve their welfare.

If a subsidy was received without meeting eligibility requirements, the overpaid amount must be repaid in writing within 60 days from the facts giving rise to the repayment obligation; otherwise it will be enforced by law.

請領本津貼的權利，不得被扣押、讓與或作為擔保。

勞保局應編製本津貼的月、季統計表及年度總報告，並報請中央主管機關備查。

本條例所需經費由中央主管機關按年度編列預算支應。

本條說明本條例的施行期間，以及 92 年 6 月 5 日修正條文自 92 年 7 月 1 日施行。

This provision defines which authority counts as the competent authority: the Ministry of the Interior at the central level, the municipal government in special municipalities, and the county/city government in counties and cities.

符合年齡、戶籍、居住與排除條件的國民，可以請領敬老福利生活津貼，每月新臺幣三千元。

中央主管機關委託勞工保險局辦理本津貼的核發及溢領催繳業務。

申請本津貼的人，必須填申請書、附上身分證正反面影本，並向戶籍所在地的鄉（鎮、市、區）公所提出；如果委託他人辦理，還要填委託書。

鄉(鎮、市、區)公所受理申請後，應在30日內完成初審意見與名冊並送交勞保局；勞保局應於次月20日前完成審核。

中央及地方主管機關須按月把指定異動資料在次月3日前送交勞保局；中央主管機關也可以會同勞保局向相關機關洽商資料與協助。

經勞保局審核符合資格的申請人，津貼自申請當月生效，並應在每月25日以前撥入申請人帳戶；不符合資格者，應書面附理由通知。

If the applicant loses eligibility or dies, the applicant or legal heir must notify the local household-registration office within 30 days, and payments stop from the following month.
