特殊境遇家庭扶助條例

This provision states the law’s purpose: to help families in special hardship with urgent care, support their self-reliance, and improve their living conditions.

符合條件且有未滿六歲子女或孫子女者，可在子女或孫子女進入私立托教機構時申請兒童托育津貼；申請須在事實發生後六個月內，並檢附證明向戶籍所在地主管機關提出。

符合條件且無力負擔訴訟費用的人，可以申請法律訴訟補助；最高金額為新臺幣五萬元。

符合特定條件且已成年的人，可以申請創業貸款補助；相關申請規則由中央目的事業主管機關訂定。

Only a person who meets the stated conditions may apply for the child living allowance and childcare allowance.

各級政府應分別編列預算，支應辦理本條例各項家庭扶助業務所需經費。

本條保障依本條例請領的津貼或補助權利，禁止扣押、讓與或供擔保；相關款項存入的專戶內存款，也不得被扣押、抵銷、供擔保或強制執行。

特殊境遇家庭可以申請第二條所列的家庭扶助項目，不限於單一項目；如已依其他法令取得生活扶助、給付或安置，原則上不重複扶助，但可補助差額。

申請緊急生活扶助的人，原則上要在事實發生後 6 個月內提出申請並附文件；核准後，主管機關要定期訪視，若生活已明顯改善就停止扶助。

符合條件且有15歲以下子女或孫子女的人，可以申請子女生活津貼；申請時要附文件，延長補助有較早申請期限，主管機關也要訪視並在生活情況明顯改善時停止津貼。

符合條件的人可以申請教育補助；同類補助不得重複領取，申請時要附證明文件，學校核對後辦理學雜費減免。

符合條件者可以申請傷病醫療補助；申請人須在傷病發生後三個月內備齊文件向戶籍所在地主管機關提出申請。
