身心障礙者權利公約施行法

This law is enacted to implement the 2006 Convention on the Rights of Persons with Disabilities and to protect the rights and equal participation of persons with disabilities.

各級政府機關 must within 2 years publish a priority review list for their laws and administrative measures, then complete required amendments, repeals, and improvements within 3 or 5 years, consult disability groups, and apply the convention first until completion.

對於本法未規定的事項，政府可以按其性質，參照公約及聯合國身心障礙者權利委員會的解釋處理。

This provision says the law takes effect on 3 December 2014.

The provisions referred to in the text have domestic legal effect.

適用公約規定的法規及行政措施，應參照公約宗旨及聯合國身心障礙者權利委員會對公約的解釋。

各級政府機關行使職權時，必須遵守身心障礙者權利保障規定，避免侵害並保護身心障礙者權利，且應積極促進其權利實現。

各級政府機關應依其法定職掌推動公約事項，跨機關事項要協調辦理；政府也要與相關國內外機構合作，並徵詢身心障礙團體意見，建立落實與影響評估及監測機制。

行政院應成立身心障礙者權益推動小組，定期開會，並處理與公約推動相關的宣導、督導、研究、報告、申訴等事項。

政府必須建立身心障礙者權利報告制度，並在法施行後二年內提出第一次國家報告，其後每四年提出一次，且要邀請相關專家學者及民間團體代表審閱。

身心障礙者在其受保障權益受侵害或難以實施時，可以依法提起訴願、訴訟或其他救濟；政府並須提供法律扶助，且可委託相關民間機構辦理。

各級政府機關應優先編列執行身心障礙者人權相關規定所需經費，並逐步實施。
