社會福利基本法

This law is enacted to protect citizens’ basic social welfare rights, establish basic social welfare policy, and improve the social welfare system.

This provision states that national employment should be supported through employment services, vocational training, occupational safety and health, and protection of labor rights.

社會住宅應向有居住需求且處於經濟或社會不利處境的國民，提供宜居住宅、租金補助或津貼及租屋協助。

中央政府必須考量國家政策、經濟社會變遷、福利需求與資源供給，訂定社會福利政策綱領，並至少每五年檢討一次。

各級政府應採現金給付、實物給付、租稅優惠、機會提供或其他方式，保障國民基本生活。

各級政府應以多元方式提供可近、便利、適足且可負擔的福利服務；委託辦理前要先就相關條件與內容進行協商，委託時還要編足經費並遵守採購與徵選規定。

中央政府應推動並執行列舉的社會福利事項；涉及各中央主管機關職掌的部分，改由該主管機關辦理。

直轄市、縣（市）政府應落實列出的社會福利事項；若事項屬於各主管機關職掌，則由該主管機關辦理。

各級政府應由首長或指定人員召集，定期邀集相關代表開會，協調、諮詢、審議並規劃社會福利政策推動。

各級政府負擔社會福利支出，依相關法律規定；中央政府得視人口分布、財政能力及其他情形，對重大社會福利政策酌予補助。

各級政府要增加社會福利經費，並優先補助經濟不利者；直轄市、縣（市）政府還要依轄內需求與資源狀況，優先在資源不足地區規劃和設置社會福利設施。

This provision defines “social welfare” to include social insurance, social assistance, social allowances, welfare services, health care, national employment, and social housing welfare matters.

各級政府應考量地方需求等因素，充實社會福利專業人力；中央主管機關得依社會福利需要，建立專業人員資格、認證、登錄、訓練及督導管理制度。

各級政府應因應社會福利需求，建立社會福利行政體系並改善人力、資格制度與訓練，以提升工作品質。

各級政府應依法辦理社會福利評鑑，並在評鑑時遵守利益衝突迴避原則、諮詢服務使用者意見，且公開評鑑項目、方式及結果。

各級政府應依法對社會福利事業提供獎勵、補助、租稅優惠、督導或其他必要協助。

各級政府在國土計畫、都市計畫、社會住宅與公共資產利用時，應納入社會福利使用需求，並要求相關設施採通用設計。

社會福利事業在提供社會福利事項時，應確保品質、保持公開透明、建立友善且安全的工作環境，並遵守相關法令與推動永續經營。

各級政府應鼓勵社區組織，推動社區發展，並推展志願服務制度，協力推動社會福利。

各級政府應鼓勵企業及社會團體履行社會責任，並共同推動社會福利。

社會福利提供者應依個別差異主動提供相關資訊與適切協助；各級政府應促進社會福利申請可及性並提供無障礙服務流程。

人民在社會福利權利受到侵害時，得依法尋求救濟。

This provision states the basic policy for social welfare: protect adequate living, respect human dignity, develop personal potential, and promote social participation and fairness.

本法施行後，各級政府應依本法規定，制定、修正或廢止社會福利相關法規。

This provision says the law takes effect on the date it is published.

This provision requires the state and government to recognize multiculturalism, ensure equal access to social welfare, and provide special protection and support for people in offshore islands, remote areas, and other groups needing assistance.

Social insurance should use compulsory enrollment, mutual aid, and risk-sharing, and provide benefits for insured events.

Social assistance should be combined with employment, education, and welfare services to help eligible people get assistance, emergency care, and support toward self-reliance.

Social allowances should provide periodic supplemental cash payments based on special needs to reduce family financial burden and help people receive adequate care.

Welfare services should be people-centered, family-centered, and community-based, and provide integrated services for nationals who need life care or other services.

This provision states that medical care should strengthen the health-care system, improve care quality, protect people’s access to treatment, narrow health gaps, and enhance care across the life course.
