平均地權條例

The implementation of average land value equalization is governed by this Act; if the Act does not cover something, the Land Act and other related laws apply.

Government must compensate land value using the expropriation-time announced land value, and in certain urban-planning reserve land cases use the average nearby non-reserve land value; above-ground building improvements are compensated by reference to reconstruction price.

出租耕地被徵收、照價收買或公有出租耕地依法撥用時，承租人要依本條規定獲得補償；土地所有權人與相關機關並負有扣交或負擔費用的責任。

中央主管機關要擬訂本條例施行區域內地籍總歸戶相關辦法，並報請行政院核定。

未規定地價的土地，原則上應全面辦理規定地價；偏遠地區及未登記土地可先劃定範圍，報中央主管機關核定後分期辦理。

After land price is determined, it must be re-determined every two years; if necessary, that period may be extended.

直轄市或縣（市）主管機關辦理規定地價或重新規定地價時，應依序調查土地價格或收益價格、劃分地價區段並送評議、計算宗地單位地價、公告及申報地價30日，並編造相關冊籍。

土地所有權人在公告期間未申報地價的，視為以公告地價的80%申報；已申報但高於120%的，改按120%計；低於80%的，得照價收買或按80%計。

已規定地價的土地要依法課徵地價稅；納稅義務人如因公告地價調整而繳納困難，可在規定繳納期間內向稅捐稽徵機關申請延期或分期繳納。

地價稅採累進稅率；累進起點地價以各直轄市或縣（市）土地七公畝的平均地價計算，但工業用地、礦業用地、農業用地及免稅土地不計入。

土地所有權人依土地價值分級繳納地價稅，基本稅率為千分之十；超過累進起點地價的部分，按不同倍數區間課徵較高稅率。

信託財產土地在信託期間，由受託人作為地價稅或田賦的納稅義務人。

This provision defines which authority is competent in each case.

Self-use residential land meeting the listed area limits is taxed at a special land value tax rate, with a one-site limit for owners, spouses, and minor dependent relatives; government-built national housing land gets the same rate from the start of construction or land acquisition.

供特定事業直接使用的土地，地價稅按千分之十計徵；但未按目的事業主管機關核定的規劃使用者，不適用。

Certain agricultural land and related farm-use land remains subject to land tax.

Urban planned public facility reserved land used for building is taxed at 6 per thousand for land value tax, except self-use residential land under Article 20. Unused land that is separated from land in use is exempt.

公有土地通常按基本稅率徵收地價稅或田賦；如果公有土地是供公共使用，則免徵。

Certain land used for listed public, educational, medical, charitable, and related purposes may receive a suitable reduction or exemption from land value tax or land tax; the Executive Yuan sets the standards and procedure.

地方政府可以就私有空地劃定區域，要求在期限內建築、增建、改建或重建；逾期未完成的，可能加徵空地稅或照價收買。

閒置的農業用地可被通知限期使用或委託經營；逾期不處理時，會被加徵荒地稅，累計滿三年仍不使用的，還可能照價收買。

照價收買土地的公告及通知，應在申報地價後、當年期地價稅開徵前辦完；符合第二十六條或第七十二條的照價收買土地，自限期屆滿次日起，當地主管建築機關應停止受理建築執照申請。

This article defines several land-use categories.

照價收買的土地，土地所有權人要在地價領取完畢或地價依法提存後60日內，把土地交付給該管直轄市或縣（市）政府。

The purchase price of land is calculated using different reference values depending on which rule is used.

土地如經主管機關驗證登記，土地改良費用和已繳納的工程受益費要併入地價計算。

If land is bought at full price and there are crops or other agricultural improvements on it, compensation must be paid.

地上建築改良物如果也屬土地所有權人所有，應一併收買；如果不是土地所有權人所有，則不必一併收買。

土地自然漲價時，土地所有權人原則上依規定繳納土地增值稅；政府出售或依法贈與的公有土地，以及接受捐贈的私有土地，免徵土地增值稅。

符合條件的私人捐贈社會福利事業用地，免徵土地增值稅。

Land gifted between spouses is not subject to land value increment tax.

信託財產的土地，在列舉的信託關係人之間移轉所有權時，不課徵土地增值稅。

土地所有權移轉或設定典權時，土地增值稅依土地漲價總數額計算；繼承移轉不課徵。

土地增值稅原則上由原土地所有權人負納稅義務；如果土地所有權是無償移轉，則由取得所有權人負納稅義務。

信託土地在特定移轉情形下，土地增值稅由受託人或歸屬權利人作為納稅義務人。

土地所有權移轉時，如果移轉現值超過原規定地價或前次移轉申報現值，超過的部分在依規定扣減後，會課徵土地增值稅。

This provision sets how to calculate land value increment tax for certain land, including land that was previously not taxed, land transferred on ownership change or into a trustee’s own property, and land held in a will-created trust.

The declared original land value or the value reported at the previous transfer must be adjusted by the government-announced price index before calculating the total land value increment amount.

直轄市或縣（市）政府要設置地價評議委員會，中央主管機關負責訂定其組織與運作辦法。

本條規定土地增值稅的稅率分級，以及依持有年限給予減徵。

出售自用住宅用地時，原則上按一定面積內的土地漲價總數額以10%徵收土地增值稅；超過面積部分按前條稅率計算。

Certain land transfers are exempt from land value increment tax, and readjusted land is given a 40% tax reduction on its first transfer after readjustment.

區段徵收土地在特定情況下可免徵土地增值稅；但領回抵價地後第一次移轉時，需按實際領回抵價地的地價作為原地價，計算漲價總數額並課徵土地增值稅。

農業使用的農地在移轉給自然人時，可以申請不課徵土地增值稅；但若取得後未維持農業使用，日後再移轉時要課稅。

權利人和義務人通常要在契約訂定後30日內，連同契約文件共同申請土地所有權移轉或設定典權登記，並共同申報土地移轉現值。

This provision sets how the declared transfer value of land is reviewed, and when the local authority may use or must use the declared value or current public land value for tax purposes.

主管稅捐機關要依規定核定免徵土地增值稅土地的移轉現值，並發給免稅證明。

賣預售屋的人，銷售前要先書面報請所在地主管機關備查；簽約或解約後 30 日內要申報登錄資訊。收受定金時要用書面契據載明買賣標的和價金，且不得保留賣方權利或其他不利買方的約定。

預售屋或新建成屋買賣契約的買受人，簽約後原則上不得將契約讓與或轉售給第三人，也不得自行或委託刊登相關廣告；銷售者通常也不得同意、協助或代刊這類轉讓/轉售廣告。

任何人不得散布不實資訊、串通虛偽交易、或以違規方式炒作不動產；主管機關也可以要求相關人員提供文件或說明。

中央或直轄市主管機關得為本條例所需資金發行土地債券。

土地所有權移轉時，土地增值稅原則上由納稅義務人繳納；逾期未繳時，取得所有權之人得代為繳納。若屬權利人依第四十七條單獨申報土地移轉現值，則其應納土地增值稅由權利人代為繳納。

依本條例施行漲價歸公之收入，應用於公共福利、社會住宅、公共設施、農業發展、農村建設、國民教育及平均地權等用途。

主管機關應依相關政策與計畫規定，全面編定各種土地用途。

主管機關經行政院核准後，得在特定地區施行區段徵收；徵收機關可在通知土地所有權人或使用人後進入勘查或測量，必要時拆除障礙物前要先通知並補償損失。

區段徵收時，主管機關要依規定補償地價；土地所有權人可申請以可建築土地折算抵付，並在特定情況下領回抵價地或改領現金補償。

原土地所有權人在區段徵收下若不領現金補償，應在徵收公告期間內書面申請改領抵價地；領回抵價地後，徵收機關再依規劃分配程序辦理土地所有權登記並通知所有權人。

If expropriated land is paid for with substitute land, the original lease and other rights are handled under the rules for urban land readjustment.

區段徵收整理後，部分土地要返還原地主、部分公共設施用地要改登記為公有；其餘土地可標售、標租或設定地上權。

主管機關得經上級核准辦理市地重劃；計畫書須先核定公告，公告滿30日後才能實施。

符合門檻的私有土地所有權人，可以向主管的直轄市或縣（市）政府申請核准後優先實施市地重劃。

本條允許推動市地重劃時獎勵土地所有權人自行組織重劃會，並要求重劃會在實施前取得過半私有土地所有權人及土地面積同意，且經主管機關核准。

重劃地區選定後，直轄市或縣（市）政府得在報請上級主管機關核定後，公告禁止或限制特定土地與建築行為；該限制期間最長不得超過一年六個月。

市地重劃時，參加重劃的土地所有權人要按受益比例共同負擔不足的土地、工程費、重劃費與貸款利息，並可用區內未建築土地折價抵付；逾期不繳可移送法院強制執行。

重劃區內土地先扣除共同負擔後，剩餘土地按地價比例分配；分配不足最小面積者可用現金補償。

主管機關在重劃分配完成後，應公告分配結果 30 日並通知土地所有權人；土地所有權人可在公告期間內以書面提出異議。

在都市發展較緩地區辦理市地重劃時，部分交換、測量、分配、登記與交接工作可以先完成；公共設施工程也可視都市發展情形另行辦理。

After land readjustment, the redistributed land is treated as the original land of the original owner once the distribution result is finalized, except where an administrative or judicial disposition is inseparable from the original land’s nature.

重劃區內應拆遷的土地改良物或墳墓，政府要公告並通知所有權人或墓主；所有權人或墓主須在期限內自行拆除或遷葬，逾期後政府可以代為處理。

市地重劃使租賃目的無法達成時，直轄市或縣市政府可逕行註銷耕地租約並通知當事人；特定情況下承租人可請求補償。

For leased land affected by replotting, the tenant may end the lease and claim compensation equal to one year’s rent if the lease purpose can no longer be achieved. If replotting changes the land’s usable value, either side may ask to change the lease and adjust rent accordingly.

If certain land rights can no longer achieve their purpose because of urban land readjustment, the rights are treated as extinguished, and the rights holders may claim compensation or request replacement registration on allocated land in some cases.

If a land readjustment participant receives no land allocation, the readjustment agency must coordinate and settle the value of the originally secured mortgage or dian right, within the amount of compensation due to the landowner.

第六十三條之一和第六十四條的請求權，必須在重劃分配結果確定後的次日起兩個月內行使。

In a land readjustment area, the readjustment agency must notify original landowners and users in writing and set a deadline for relocation or takeover.

重劃機關要依重劃結果重新編號並送件，由登記機關直接辦理權利變更登記並換發土地權利書狀；逾期未換領的，原權利書狀失效。

The government may publicly sell land it acquired through lawful purchase at appraised price, zone expropriation, or land readjustment, and this is not restricted by Article 25 of the Land Act.

直轄市或縣（市）政府應就尚未建築的私有建築用地，限制土地所有權人可持有的最高面積；一般上限為 10 公畝。

直轄市或縣（市）政府應通知超額土地所有權人在二年內出售或作建築使用；逾期未辦理時，政府得按價格收買並整理後出售供需用土地人建築使用，但建設發展較緩地段不適用此規定。

Certain resold land buyers must start construction within one year of purchase; if they do not and have no approved extension, the local government may take the land back at the original price.

For land subject to a construction deadline, the landowner must negotiate with the tenant, borrower, or superficies holder about building, additions, or reconstruction after notice; if no agreement is reached, the landowner may end the lease or loan or cancel the superficies right.

收回土地的所有權人，除要補償承租人、借用人或地上權人改良土地所支出的費用外，還要就建築改良物給予補償。

出租耕地依法編為建築用地後，出租人為自行建築或出售作建築使用，可以終止租約；終止後，若收回的耕地滿一年仍未依使用計畫建築，直轄市或縣（市）政府可以照價收買。

耕地出租人終止租約收回耕地時，須補償承租人的改良費用、未收穫農作改良物，以及依公告土地現值扣除預計土地增值稅後餘額三分之一的補償；公有出租耕地也適用同樣規則。

土地所有權人要書面向直轄市或縣（市）政府申請終止耕地租約；政府會審核、協調補償，必要時可移送法院強制執行返還耕地。

When compensation is paid for expropriated or purchased land, the competent municipal or county government must withhold any unpaid land taxes and late-payment charges and then pay the remaining amount to the land owner.

私法人買受供住宅使用的房屋，原則上要先檢具使用計畫並經中央主管機關許可；許可文件有效期一年。取得後登記完畢起五年內，原則上不得移轉、讓與或辦理預告登記。

If a land buyer resells the land before the transfer registration is completed, a fine of up to 20 times the registration fee may be imposed.

受贈土地的財團法人如未依捐贈目的使用、違反設立宗旨，或未將土地收益全部用於該事業，除補繳土地增值稅外，還要被處以應納稅額二倍的罰鍰。

This provision sets fines and correction orders for several real-estate reporting, disclosure, document, and resale violations.

違規買賣契約讓與、轉售、刊登相關廣告，或規避、妨礙、拒絕查核者，會被地方主管機關處以罰鍰，並可能命限期改正、必要處置及按次處罰。

民眾可以向直轄市、縣（市）主管機關檢舉不動產銷售、買賣或申報登錄資訊的違規情事；主管機關在查證屬實並處罰鍰後，可發給檢舉獎金，並且應從罰鍰收入提撥一定比例作為查核經費。

A person who damages or moves land readjustment survey markers, or obstructs land readjustment by force, coercion, or other unlawful means, may be punished.
