測量標設置保護條例

測量標的設置保護，依本條例辦理。

禁止在測量標上堆積瓦礫、拋擲雜物、懸掛繩索、拴牲畜、貼廣告或塗抹污損；違反者可處拘役或五十元以下罰金。

因過失毀損測量標或使其失效的人，不受處罰，但必須賠償。

在測量標附近建築而可能妨礙其效用時，相關機關、團體或人民須先說明理由、繪圖，並向該管測量機關申請核准，且自行負擔遷移、改建或重建所需費用。

If this Regulation does not cover a matter, the Criminal Code applies.

本條例的施行細則由行政院訂定。

本條例自公布日起施行。

This provision lists types of measurement markers and related marker equipment.

If permanent survey marks need public land or expropriated private land, the matter must be handled under the Land Act.

When a surveying marker faces a public building or other obstruction, it should be avoided if possible. If demolition is unavoidable, the user and owner must not refuse, and the surveying authority must compensate the loss.

在通知後，使用人及所有人不得阻止為設置測量標或施行測量而進入公有或私有建築物、土地。

The competent local government must arrange for the protection of installed survey markers.

毀損或移動已設置的標石、標桿、燈標或浮標的人，可能受三年以下有期徒刑、拘役或五百元以下罰金。

毀損或移動已設置的各種覘標、標架、標柱者，會被處一年以下有期徒刑、拘役或三百元以下罰金。

Damaging or moving installed flags, water gauges, boundary posts, or measuring rods can be punished by up to six months in prison or a fine of up to 100 yuan.
