租賃住宅市場發展及管理條例

This provision states the purpose of the law: to protect housing rights, improve the rental housing market, protect the rights of rental parties, and develop rental housing services.

在列明情形發生時，出租人可以提前終止租賃契約；承租人不得請求任何賠償。

承租人在列明事由發生時，可以提前終止租賃契約；出租人不得請求任何賠償。

租賃契約終了時，租賃當事人應共同完成房屋及附屬設備點交；未到場者經催告仍不會同，視為點交完成。

出租人刊登的租賃住宅廣告要和事實一致；租賃住宅服務業者作為廣告主時，還要標明業者名稱。

主管機關得建立住宅租賃服務制度並提供相關研究、糾紛處理與諮詢，也得輔導獎勵相關機關與團體；涉及弱勢者的事項，應優先由服務弱勢者的團體辦理。

主管機關得輔導成立租賃服務性非營利團體；該團體在執行業務時，應主動了解並詢問當事人是否需要通譯，必要時並應選任通譯。

住宅租賃爭議時，出租人或承租人可以向直轄市或縣（市）政府申請調處，且不用繳調處費用。

符合條件的個人住宅所有權人，可以依規定減徵租金所得稅；租金收入在每屋每月新臺幣6,000元以下免納綜合所得稅，超過部分按不同區間計算。

符合前條規定的租賃住宅，地方政府可以適當減徵地價稅和房屋稅。

Rental housing service businesses must get permission, complete company and business registration on time, and follow special rules for branch offices and business associations.

This provision defines the competent authority: the Ministry of the Interior at the central level, the municipal government in a special municipality, and the county/city government at the county/city level.

符合列舉情形者，不得擔任租賃住宅服務業負責人；已擔任者，主管機關可命限期改正，未改正則可廢止許可、註銷登記證，並通知公司登記主管機關廢止登記。

租賃住宅服務業變更許可事項、登記事項，或所置租賃住宅管理人員異動時，都要在指定期限內向直轄市、縣（市）主管機關辦理。

租賃住宅服務業的營業保證金在特定條件下可以用金融機構保證函擔保；金額不足時，公會全聯會要通知補足，逾期未補足則通知主管機關處罰。

租賃住宅服務業在合併或變更組織型態時，已繳存的營業保證金要一併移轉；營業保證基金原則上也不得因債權債務關係而被讓與、扣押、抵銷或設定負擔，但第三十一條第四項情形除外。

租賃住宅服務業在特定情形下，可以向全國聯合會書面請求退還營業保證金，但不包括孳息。

租賃住宅服務業 must hire qualified rental housing managers for management and leasing work, keep at least one full-time manager, add one for each branch office, and full-time managers may not work for two or more such businesses at the same time.

通過指定訓練並測驗合格的人，須在一年內完成登錄並取得證書，才能擔任租賃住宅管理人員；證書有效四年，到期前六個月內要檢附換證訓練合格證明辦理重新登錄和換證。中央主管機關也可訂定相關辦法。

有第二十條第四款或第五款情形的人，不得擔任租賃住宅管理人員；已擔任者，中央主管機關可撤銷或廢止證書並公告，且要註銷登錄。

代管業必須先與委託人簽訂委託管理租賃住宅契約書，才能開始執行租賃住宅管理業務；也不得再委託其他代管業執行該業務。

包租業在取得出租人同意並與出租人簽約後，才可以刊登廣告及執行業務；與次承租人簽約時還要提供文件、載明特定內容，並在簽約後30日內書面通知出租人。

This article defines key terms used in the statute.

包租業在出租人提前終止租賃契約時，必須在知悉後5日內通知次承租人，並協調返還房屋、點交、退還預收租金與押金，還要協助次承租人優先承租其他住宅。

租賃住宅服務業在可歸責原因不能履約、或其受僱人執行業務有故意過失致損害時，負賠償責任；符合條件時，被害人可向全國聯合會請求代為賠償。

租賃住宅服務業應由專任租賃住宅管理人員簽章處理列出的文件；部分規定對包租業務或代管業務有不適用例外。

租賃住宅服務業 must 在營業處所明顯處及網站揭示指定文件資訊。

租賃住宅服務業和包租業 must 在30日內向地方主管機關提供或申報租賃住宅相關資訊；主管機關 may 查核、要求文件或說明，且查核不得超出必要範圍。

主管機關可以檢查租賃住宅服務業的業務；租賃住宅服務業不得規避、妨礙或拒絕檢查。

如果不是租賃住宅服務業，卻經營代管或包租業務，主管機關可以禁止營業，並可對負責人或行為人處罰鍰。

租賃住宅服務業有列舉違規情形之一時，直轄市、縣（市）主管機關可處新臺幣1萬至5萬元罰鍰，並命限期改正；逾期未改正者，得按次處罰。

租賃住宅服務業有特定違規情事時，直轄市、縣（市）主管機關可裁處新臺幣6,000元至30,000元罰鍰，並命限期改正；逾期未改正者，得按次處罰。

If a lease contract party under Article 5(2) violates the central competent authority’s announced required or prohibited terms and then fails to correct it by the deadline set by the local authority, a fine is imposed.

包租業或次承租人違反申報、資訊真實性或查核配合義務時，主管機關可處罰鍰；部分情形先限期改正，逾期未改正再罰。

租賃住宅服務業有違規情形時，地方主管機關可限期命其改正；逾期未改正，得處新臺幣6,000元以上30,000元以下罰鍰。

This provision says certain rental housing is exempt from the act’s rules.

本條例施行前已經營代管業務或包租業務者，可在施行日起繼續營業二年；二年後若未取得第十九條所定登記證，就不得繼續營業。

Certain rental housing managers may keep working for 2 years after the law starts, but after that they may not continue unless they have the required certificate.

Foreigners may take the rental housing manager training and exam, and those who pass, register, and obtain the certificate may be employed by a rental housing service business. Foreigners serving in Taiwan as rental housing managers must use Chinese for related business documents and drawings, unless the parties do not understand Chinese, in which case another language they understand may be added.

全國聯合會成立前，其應辦理的業務，由中央主管機關指定的機關、團體或學校辦理。

受理租賃住宅服務業許可及登記證申請的機關，應收取規費；收費標準由中央主管機關訂定。

中央主管機關有權訂定本條例的施行細則。

本條規定本條例的施行時間：原則上自公布後六個月施行；修正條文則自公布日施行，但第三十四條及第三十八條之二的施行日期由行政院另定。

包租業和出租人之住宅包租契約，應記載與不得記載的事項由中央主管機關訂定；違反者，相關條款無效，部分情況下整份契約也可能無效。

租賃住宅的租金，由出租人和承租人約定，且不適用土地法第九十七條。

押金金額不得超過兩個月租金總額；租約消滅且承租人返還房屋並清償租約債務時，出租人應返還押金或扣抵後的餘額。

出租人 must provide a rental home fit for agreed residential use, keep it habitable during the lease, and tell the tenant before signing which repairs the landlord handles and how to contact them for needed repairs.

轉租住宅前，轉租人必須先取得出租人的書面同意。
