都市計畫法

This law is enacted to improve residents’ living conditions and promote balanced planned development of cities, towns, and rural townships.

列舉的地方應擬定市（鎮）計畫。

Certain listed areas must prepare a township/street plan, and county governments may designate additional areas that must do so.

A specific area plan must be formulated for designated areas for industrial development, scenic beauty, or other purposes.

This provision assigns which local government bodies may draft different kinds of urban plans.

必要時，特定區計畫可由內政部訂定；經內政部或縣（市）政府指定應擬定的市（鎮）計畫或鄉街計畫，必要時可由縣（市）政府擬定。

市鎮計畫要先擬定主要計畫書，並附主要計畫圖；圖的比例尺不得小於一萬分之一，實施進度以五年為一期，最長不得超過二十五年。

The matters to be shown in township street plan and special area plan main plans may be simplified, as needed, by referring to all or part of the matters in the previous article, and may be prepared together with the detailed plan.

在未發布細部計畫的地區，建築使用和地形變更應受限制；但在主要計畫發布已逾二年且符合特定條件時，主管建築機關得指定建築線並核發建築執照。

A main plan must be sent for review after it is drafted, and certain plans must first seek opinions from relevant local governments and township/town/county-administered city offices.

主要計畫在送都市計畫委員會審議前，應先公開展覽30天並舉行說明會，還要公告日期和地點；民眾或團體可在展覽期間書面提出意見。

都市計畫依本法規定；本法沒有規定的部分，適用其他法律。

本條規定主要計畫與特定區計畫的核定、備案程序，以及在特定情形下的事前徵詢與三十日視為准予備案規則。

地方直轄市、縣（市）政府在主要計畫核定或備案後，應在30日內發布實施，並公告發布地點及日期；內政部訂定的特定區計畫也由地方政府依此辦理。

細部計畫要用細部計畫書和細部計畫圖，載明指定事項；細部計畫圖比例尺不得小於一千二百分之一。

細部計畫的核定與實施，原則上由地方政府辦理，但特定情形由內政部核定實施；核定發布後，還須在一年內完成相關樁位、坐標、分割測量與圖上測繪。

土地權利關係人可以為了促進土地利用，配合當地分區發展計畫，自行擬定或變更細部計畫；申請時並應附具事業及財務計畫。

土地權利關係人被拒絕後，可以向內政部或縣（市）政府請求處理；經依法處理後，不得再提出異議。

都市計畫發布實施後，不得任意變更；擬定計畫的機關至少每三年或五年通盤檢討一次，並就非必要的公共設施用地變更其使用。

都市計畫發布實施後，遇有戰爭、災害、重大事變、重大災害風險、國防或經濟發展需要，或配合重大設施時，地方政府應視情況儘速變更；內政部或縣市政府也可指定原擬定機關限期辦理，必要時可直接變更。

主管機關在特定都市計畫變更情形下，得要求土地權利關係人提供或捐贈變更範圍內的公共設施用地、可建築土地、樓地板面積或一定金額。

重大投資開發案件在符合都市計畫、環境影響評估及水土保持等條件時，可以採平行作業；必要時也可以聯合作業，由都市計畫主管機關召集聯席會議審決。

If a main plan or detailed plan is amended, the related review, public exhibition, reporting for approval, and implementation steps must follow Articles 19 to 21 and 23.

為都市計畫的訂定、擬定或變更，內政部及地方機關可以派人進入公私土地勘查或測量；遇到圍障土地或需要移除障礙物時，須先通知所有權人或使用人，並對損失給予適當補償。

This provision defines “urban plan” as a planned development in a certain area covering important urban-life facilities and reasonable land-use planning.

在都市計畫地區內，地方政府必要時可以獎勵私人或團體投資公用事業及其他公共設施，並可收取一定費用。

Approved private persons or groups may apply Article 29 when needed for the business.

Urban planning may designate residential, commercial, industrial, and other use zones, and may further subdivide them with different levels of use controls.

In urban planning areas, land may be reserved as agricultural land or protected areas, and building use may be restricted based on terrain, existing use, or military security needs.

Residential areas are designated to protect the living environment, and land and buildings there must not be used in ways that interfere with residential quiet, safety, or hygiene.

Commercial districts are designated to promote business development, and land and buildings there must not be used in ways that hinder business convenience.

Industrial zones are designated to support industrial development, and their land and buildings are mainly for industrial use.

Land and buildings in this use zone are mainly to be used for the stated purposes.

特定專用區內的土地和建築物，不得作違反其特定用途的使用。

內政部或直轄市政府得依地方實際情況，就都市計畫使用區與特定專用區的土地及建築物使用、容積率、空地、院落、停車場、高度及相關交通、景觀、防火事項，在施行細則中作必要規定。

This provision says the competent authority under the Act is the Ministry of the Interior at the central level, the municipal government in a special municipality, and the county or city government in a county or city.

Urban plans, once published and implemented, are to be administered under the Building Act.

都市計畫實施後，既有但不符分區規定的建築物，原則上不得增建或改建，但可以修繕。

Within urban planning areas, land should be set aside for listed public facilities according to actual needs, and public land should be used first if suitable.

Public facility land should be planned by choosing the project, location, and area based on current and future conditions.

Road systems, parking places, and gas stations should be arranged according to zoning, traffic conditions, and expected development; railways and highways passing through urban planning areas should avoid running through city centers.

Parks, sports facilities, green spaces, squares, and children's playgrounds must be systematically laid out according to planned population density and natural environment, and their occupied land area must generally be at least 10% of the total planned area.

Certain public facilities must be appropriately located according to the distribution of neighborhood units or residents.

Certain facilities must be set up at suitable edge locations.

指定的公共設施保留地，如果是供公用事業設施使用，由該事業機構依法徵收或購買；其餘部分由主管政府或鄉、鎮、縣轄市公所依列舉方式取得。

公共設施保留地的地價補償，原則上以徵收當期毗鄰非公共設施保留地的平均公告土地現值計算；必要時可加成，但加成最高不得超過40%。地上建築改良物則以重建價格補償。

Urban plans should be prepared based on current and past conditions and expected development over the next 25 years.

臨時建築權利人在接到地方政府通知後，必須自行無條件拆除並回復原狀。

Certain compensation for public reserved land is exempt from income tax, and transfers by inheritance or gifts between spouses or direct blood relatives are exempt from inheritance or gift tax.

私有公共設施保留地可以申請與公有非公用土地交換；符合劃設逾二十五年且未經政府取得的，得優先辦理交換。

指定為公共設施保留地後，不得作妨礙其指定目的的使用；但可繼續原有使用，或改作較不妨礙目的的使用。

在都市計畫範圍內，政府徵收或撥用土地時不得妨礙當地都市計畫；公有土地並應配合都市計畫處理。

經核准投資都市計畫事業的私人或團體，對於所需公共設施用地，公有地可申請向管理機關租用；私有地且無法協議收購時，應先備妥價款，申請該管直轄市、縣（市）政府代為收買。

承租的公有土地不得轉租；如承租人無力經營、違反核准使用計畫或不遵守相關法令，地方政府可通知管理機關終止租用、改租他人，必要時還可接管經營，並應補償既有設施的資產重估價額。

地方政府對其代為收買的土地，在土地移轉或違反原核准使用計畫時，可以按原價額優先收買。

私人或團體捐獻已完成的公共設施及土地給政府時，應登記為所在市、鄉、鎮、縣轄市所有，並由該地方自治團體負責維護修理，還可予以獎勵。

主要計畫公布實施後，當地地方政府機關應依第十七條，就優先發展地區擬具事業計畫，並推動新市區建設。

縣市政府為新市區建設可辦理區段徵收或土地重劃；重劃時，地政機關要先擬計畫書並經核定後公告30日才能實施。

新市區建設範圍內辦理區段徵收時，各級政府管理的公有土地，應交由當地直轄市、縣（市）政府依新市區建設計畫併同處理。

直轄市及縣（市）政府可以限制都市計畫範圍內土地的使用，避免妨礙都市計畫。

Public land with an assigned use may, if it does not conflict with a new town construction plan, be adjusted in location or boundaries after prior written notice to the local municipal or county government, and then is exempt from sale.

Private persons or groups may conduct a new town construction business only after approval from the local municipal or county government, and the application must cover at least 10 hectares and include the listed plans.

私人或團體辦理新市區建設事業，計畫書件核准後，可以請求地方政府或公所配合興修相關公共設施並提供技術協助。

地方政府和鄉鎮市公所得在認為有必要時，依細部計畫劃定窳陋或髒亂地區範圍，並訂定更新計畫實施。

Urban renewal treatment is divided into reconstruction, renovation, and maintenance, and local governments must set designation standards for renewal areas and submit them to the Ministry of the Interior for approval.

更新計畫應以圖說列明法定事項。

Area delineation and the drafting, amendment, submission for approval, and publication of the update plan must each follow the prescribed procedures for the relevant detailed plan.

The local special municipality, county(city) government, or township/county-administered city office must handle the update plan.

辦理更新計畫時，對更新地區範圍內的土地及地上物，得依法進行徵收或區段徵收。

在更新地區範圍劃定後，需拆除重建的地區不得進行地形變更、建築物新建、增建或改建。

This provision defines several urban-planning terms, including major plan, detailed plan, urban planning enterprise, priority development area, new district construction, and old district renewal.

辦理更新計畫的機關或機構可以出售或標售整地後的基地；受讓人必須在更新計畫期限內重建。

地方政府可以在當地分區使用規定之外，另行補充規定，但要先報經內政部核定後才能實施。

執行更新計畫的機關或機構可以為整建地區的建築物訂定期限，要求改建、修建、維護或充實設備，並應提供技術輔導。

The national housing construction plan should coordinate with local urban renewal plans, and its annual plan for cheap housing should set an appropriate share and give priority to renting or selling to residents who must be relocated from the urban renewal area.

內政部、各級地方政府及鄉、鎮、縣轄市公所，為審議及研究都市計畫，應分別設置都市計畫委員會；其組織由行政院定之。

內政部、各級地方政府及鄉、鎮、縣轄市公所應設置經辦都市計畫的專業人員。

當地地方政府或鄉、鎮、縣轄市公所管理這些都市計畫相關公有土地，且在依法處分時，所得價款可以補助方式撥作當地都市計畫建設經費。

地方政府及鄉、鎮、縣轄市公所應以列舉方式籌措實施都市計畫所需經費。

中央、直轄市或縣（市）政府在為實施都市計畫或土地徵收時，可以發行公債。

In urban planning areas, unlawful land or building use or related construction activities can be fined, and the local government may order demolition, alteration, cessation of use, or restoration.

Urban plan drafting and changes must follow the procedure set out in this Act.

不遵守前條要求而仍未拆除、改建、停止使用或恢復原狀的人，除依法可被行政強制執行外，還可能被處六個月以下有期徒刑或拘役。

在新訂、擴大或變更都市計畫時，可先劃定計畫地區並經委員會通過後，禁止區內建築新建、增建、改建、變更地形或大規模採土石；特定情形可特許施工，最長禁建二年。

直轄市及縣（市）政府如需要，得在收到內政部核定公文後一個月內申請復議，但只能申請一次。

依本法徵收的土地，使用期限要依核准計畫期限辦理，且不受土地法第219條限制。

This provision says certain land and buildings may be handled through floor area transfer, and the Ministry of the Interior sets the detailed rules by regulation.

區段徵收土地在開發整理後，依核准計畫再出售時，得不受土地法第25條限制；原土地所有權人也可在標售前依規定買回一定比例的土地。

直轄市的本法施行細則由直轄市政府訂定並送內政部核轉行政院備案；省的施行細則由內政部訂定並送行政院備案。

都市計畫發布實施後，地方政府或鄉鎮市公所每年年終後一個月內要編報告，逐級送內政部或縣市政府備查。
