市區道路條例

Municipal road construction, improvement, maintenance, use, management, and funding are governed by this Act; anything not covered by it follows other laws.

Land needed for repairing urban roads may be expropriated according to law.

道路修築計劃要把市區道路用地內既有障礙建築物的拆除、遷讓和補償一起納入規劃；計劃公告後要通知所有權人限期處理，必要時可代為執行。

在主要道路交叉或道路與鐵路相交處，主管機關應依交通量與交通安全需要，與相關機關協商，並儘量採設立體交叉通過。

市區道路改善加舖路面時，若寬度在15公尺以內，應一次全寬鋪設。

If a city road is too wide to complete at once, a phased completion plan may be prepared and submitted for approval. Existing roads that do not meet the required width must be widened gradually.

道路工程施工期間，可以限制車輛、行人通行，或改道通行；施工期間及展延期間都應公告，且不得拖延。

In road land areas, construction is prohibited except for roads, ancillary works, and facilities required under Article 8.

公路路線應盡量避開市區中心；如果必須通過市區，且將部分市區道路劃入公路系統時，路線與寬度由公路主管機關及同級市區道路主管機關協商，並報請上級主管機關核定。

經核定劃為公路路線系統的市區道路，其工程設計標準要依都市計畫或主管機關規定，由公路主管機關與同級市區道路主管機關協商處理，且不得低於該公路路線標準。

跨越兩個行政區域的市區道路渡口、橋樑或隧道，由相關主管機關協商共同管理；也可由上級主管機關指定一方管理。

This provision defines “市區道路” as roads in three categories of areas: roads inside urban planning areas, roads inside special municipality or city administrative areas outside urban planning areas, and roads in population-concentrated areas approved by the central competent authority.

當水圳、堤堰及其他相關建築物與市區道路互相依賴時，主管機關應協商，並把管理交由效用較大的一方。

內政部在特別需要時，得會商有關機關，將市區道路全部或一部分改由其他機關代管；不需要時，應回復由原主管機關管理。

When an urban road is built or improved under this Act, an engineering benefit fee may be collected under the county/city engineering benefit fee collection rules.

This provision lists funding sources for urban road construction, improvement, and maintenance, and assigns fee-setting and collection tasks for certain charges.

Urban road construction and its budget estimates must be submitted for approval by the relevant level of council.

當市區道路被劃入公路系統時，修築、改善、養護計劃的擬訂，以及經費分擔，應由公路與市區道路主管機關協商辦理。

市區道路在特定情況下的工程經費，由地方主管機關與共同使用機關或私人團體協商分擔，也可以由一方單獨負擔。

要挖掘市區道路的工程，原則上要向主管機關申請許可並繳交許可費；緊急為了生命、財產或公共安全時，可先處置後補申請。

市區道路主管機關在必要時，可以限制道路的使用。

沿市區道路附近的居民有協助維護道路、保持道路清潔的義務。

This provision defines what counts as “市區道路附屬工程” (urban road ancillary works).

直轄市、縣（市）政府經上級市區道路主管機關核准後，得設立工程機構。

直轄市、縣（市）政府應在每一會計年度終了後二個月內，彙編上一年度轄區內道路行政及建設情形的報告，送內政部備查。

內政部訂定市區道路及附屬工程設計標準；直轄市或縣（市）政府可就所轄市區道路的管理事項另定規定，並報內政部備查。

違規擅自建築或開挖道路，或未在期限內修復道路/修復不良者，市區道路主管機關得裁處罰鍰。

If a person violates Article 9(3) and does not complete self-correction in time, they may be fined NT$5,000 to NT$25,000, and the fine may be repeated monthly until the correction is finished.

This provision says the act takes effect on the date of publication, and the commencement date for amended provisions is set by the Executive Yuan.

This provision identifies which authority is responsible for city road matters: the Ministry of the Interior at the central level, municipal governments in special municipalities, and county/city governments in counties and cities.

鄉（鎮、市）公所在縣轄區內，得辦理市區道路的修築、改善及養護。

市區道路修築的系統和寬度，原則上要依都市計劃辦理；沒有都市計劃時，先擬訂道路系統圖並標明寬度、連同修築計劃報請核定後公布施行。

When constructing urban roads, the related ancillary works in Article 3 should be included in the construction plan and handled together as needed.

擬訂市區道路修築計劃時，應先與道路範圍內相關事業的主管機關聯繫並取得協議；計劃核定後，相關設施要配合修築計劃辦理。

騎樓和無遮簷人行道地平面要依設計標準與道路高程建造，不得高低不平。
