國家公園法

This Act is enacted to protect national special natural scenery, wildlife, and historic sites, and to support public recreation and research.

內政部或其委託機關為勘定國家公園區域、訂定或變更國家公園計畫時，得進入公私土地進行勘查或測量，但須先通知土地所有權人或使用人。

內政部依國家公園計畫決定國家公園事業；主管機關執行，必要時可經核准由地方政府、公營事業機構或公私團體在監督下投資經營。

國家公園可以依現有土地利用型態與資源特性，劃分管理區域。

In national park areas, people are prohibited from burning vegetation, hunting or catching animals or fish, polluting water or air, picking or cutting flowers and trees, carving on trees/rocks/signs, littering, driving vehicles into unauthorized areas, or doing other acts banned by the park authority.

In general control or recreational areas, the National Park Headquarters may permit certain listed activities; for especially large or important permits, it must seek approval from the Ministry of the Interior.

在史蹟保存區內，列舉的行為都要先經內政部許可。

在史蹟保存區、特別景觀區或生態保護區內，除第一項第一款及第六款已經許可的情形外，相關許可事項均禁止。

In special scenic areas or ecological protection areas, the listed activities are allowed only if they are specially necessary and permission is obtained from the National Park Management Office.

生態保護區設於公有土地內；區內原則上禁止採集標本、使用農藥及興建人工設施。

進入生態保護區前，須先取得國家公園管理處的許可。

National park management is governed by this Act, and any matters not covered here are governed by other laws.

在特別景觀區和生態保護區內，水資源及礦物開發要先經國家公園計劃委員會審議，再由內政部報請行政院核准。

學術機構可以在國家公園區域內從事科學研究，但要先把研究計畫送請國家公園管理處同意。

國家公園管理處應視實際需要設置專業人員，負責解說天然景物及歷史古蹟，並提供必要的服務與設施。

國家公園事業的費用，依執行方式由公庫或經營者負擔；相關分擔先經委員會審議，再由內政部呈請行政院核定。內政部也可以接受私人或團體捐贈給國家公園發展的財物和土地。

Anyone who violates Article 13, paragraph 1 may be sentenced to up to six months’ imprisonment, detention, or a fine of up to 1,000 yuan.

Violating any of the listed provisions can lead to a fine of up to 1,000 yuan; serious cases causing severe harm can lead to up to 1 year imprisonment, detention, or a criminal fine of up to 1,000 yuan.

Anyone who violates one of the listed provisions is subject to a fine of up to 1,000 yuan.

違反本法並依第24至26條受罰者，原則上要回復損害原狀；若不能回復或有重大困難，則要賠償損害。

Rules for national parks apply to changes, management, and penalties for violations in national natural parks.

本法的施行區域由行政院以命令決定。

The Ministry of the Interior drafts the implementing rules for this Act and submits them to the Executive Yuan for approval.

國家公園的主管機關是內政部。

This law takes effect on the date it is promulgated.

內政部為選定、變更或廢止國家公園區域，或審議國家公園計畫，設置國家公園計劃委員會；委員為無給職。

National parks must establish a management office, and the office’s organization rules are prescribed separately.

本條列出國家公園的選定基準，並授權主管機關在條件符合且資源或面積較小時，選定為國家自然公園；已選定者則要依保育與遊憩特性分類管理。

內政部應將國家公園的設立、廢止及區域劃定或變更，報請行政院核定公告。

This provision defines several national park-related terms and protected zone types.

Public land needed for a national park plan may be applied for appropriation according to law; private land may stay in its original use if it does not hinder the plan, but may be expropriated if needed for the plan.
