都市危險及老舊建築物加速重建條例

This provision states the law’s purpose: to speed up reconstruction of dangerous and old deteriorating buildings in urban planning areas, improve living conditions, and enhance building safety and quality of life.

各級主管機關可以對重建計畫給予補助，並在符合指定情形時提供重建工程必要融資貸款信用保證；中央主管機關則應補助直轄市、縣（市）主管機關所需經費。

商業銀行為重建計畫提供融資時，該放款可不受銀行法第七十二條之二限制；必要時，金融主管機關也可以規定這類放款的最高額度。

辦理結構安全性能評估機構及其人員若違反第三條第五項，作不實簽證或出具不實評估報告書，會被處罰鍰。

中央主管機關有權訂定本條例施行細則。

This provision says the statute takes effect on the date it is promulgated.

This provision defines the competent authority: the Ministry of the Interior at the central level, the special municipality government in a special municipality, and the county/city government in a county or city.

This provision sets the scope of eligible buildings, allows certain reconstruction-related arrangements, requires owners to commission structural safety assessments for some cases, forbids false certification or false assessment reports, and lets the central competent authority set detailed rules.

主管機關可以補助結構安全性能評估費用；若對前條所列評估結果有異議，直轄市或縣市政府應成立鑑定小組受理申請，且鑑定結果為最終鑑定。

新建建築物的起造人申請重建時，應先擬具重建計畫，取得計畫範圍內全體土地及合法建築物所有權人同意，向直轄市、縣（市）主管機關申請核准後，再依建築法令申請建築執照。

公有財產土地及合法建築物原則上應參與重建，但符合列舉情形者例外；其參與方式可採協議合建、標售、專案讓售等，相關條件與程序由主管機關另定。

重建計畫範圍內的建築基地，得按需要給予建築容積獎勵，但獎勵後容積受本條規定上限限制；申請者不得同時適用其他法令的建築容積獎勵。

Reconstruction under this provision may receive relaxed building coverage ratio and building height, but the relaxation standards are set by the local competent authority.

符合條件的重建計畫，可經地方主管機關同意後減免稅捐；部分情形可免徵或減半徵收，並有期限與排除規則。

直轄市、縣（市）主管機關應協助合法建築物重建，並在符合條件時提供社會住宅或租金補貼。
