集會遊行法

本法說明其目的在保障人民集會、遊行的自由並維持社會秩序；未規定的事項，適用其他法律。

符合列舉情形的人，不得擔任需許可的室外集會、遊行的負責人、代理人或糾察員。

申請室外集會或遊行，原則上應予許可，但有列舉情形者除外。

主管機關 must notify the responsible person in writing within 3 days of receiving an application, or within 24 hours for applications made under the proviso in Article 9(1). If it does not notify within those time limits, the application is treated as approved.

A permit notice for an outdoor assembly or parade must list specified details, and a denial notice must state the reasons and appeal/remedy procedure.

主管機關在許可室外集會、遊行時，可以對特定事項作必要限制。

室外集會、遊行在許可後，主管機關在緊急必要時可以廢止許可或變更時間、地點、路線或限制事項；若符合第十一條第一款至第六款情形，則應撤銷或廢止許可。

Outdoor assembly and parade responsible persons may file a written appeal within the stated time limits, and police authorities must then review and notify them within set deadlines.

依前條提出的申復，不會影響原通知的效力。

集會、遊行的負責人必須親自在場主持並維持秩序；如果場地或路線使用後留下廢棄物或污染，也要負責清理。

If the person responsible for an assembly or parade cannot be present to主持 or maintain order, a proxy may act for them.

This provision defines “assembly” and “procession” for the Act.

The person responsible for an assembly or parade may designate marshals to help maintain order, and any marshal on duty must wear an armband marked “糾察員”.

People参加集會或遊行 must follow order-maintenance instructions from the responsible person or police officer. A person who obstructs the event may be expelled, and expelled persons must leave the scene immediately.

當集會或遊行的負責人宣布中止或結束時，參加人應立即解散；若參加人未解散，負責人有疏導勸離的責任。

集會、遊行的負責人、代理人、糾察員和參加人，不得攜帶足以危害他人生命、身體、自由或財產安全的物品。

集會或遊行時，警察人員可到場維持秩序；主管機關在負責人請求下，應到場疏導交通並維持秩序。

主管機關可對特定集會、遊行情形警告、制止或命令解散，必要時並可強制執行。

Restrictions, refusals, or dissolution orders for assemblies and processions must be fair, reasonable, and limited to what is necessary.

A responsible person or agent for a permitted assembly or parade who violates Article 18 may be fined up to NT$30,000.

If an assembly or protest is ordered to disperse by the competent authority and does not disperse, the responsible person, agent, or host may be fined. A separate fine applies if the responsible person fails the duty referenced in Article 22(2) and the assembly or protest continues.

If an assembly or parade is ordered dissolved by the competent authority and is not dissolved, and it continues despite a stop order, the ringleader is punishable by up to two years’ imprisonment or detention.

This provision defines which police body is the competent authority for assemblies and processions: normally the local police precinct, or the municipal/county police bureau if the area spans multiple precincts.

During a gathering or procession, insulting or defaming a public office, a public servant performing official duties, or another person is punishable by imprisonment, detention, or a fine of up to NT$60,000.

Anyone who violates Article 5 may be punished with imprisonment up to 2 years, detention, or a fine up to NT$30,000, or both.

在集會、遊行中，如果糾察員不法侵害他人權利，負責人與行為人要連帶負損害賠償責任；但若損害是行為人基於自己意思所造成，則由行為人自行負責。

第二十三條規定之物品，不論屬於誰，都可以扣留並依法處理。

經通知後仍逾期不繳納依本法處罰鍰者，會移送法院強制執行。

This provision says the Act takes effect on the date it is promulgated.

集會遊行不得主張共產主義或分裂國土。

對合法舉行的集會、遊行，不得以強暴、脅迫或其他非法方法妨害。

集會、遊行不得在特定政府、機場港口、軍事、外館等地區及其周邊範圍舉行；經主管機關核准者例外。

集會、遊行應有負責人；依法設立之團體舉行者，其負責人是團體代表人或其指定的人。

Outdoor assemblies and parades need a permit from the competent authority, but listed event types are exempt; indoor assemblies do not need a permit unless sound or audio-visual equipment makes them count as outdoor assemblies.

室外集會、遊行通常要由負責人在六天前向主管機關申請許可，並附上法定資料；符合重大不可預見緊急事故等條件時，可不受六天前申請限制。
