About this statute

未滿十四歲人和心神喪失人實施違警行為,不罰。 For certain listed persons, punishment for violations may be reduced; after punishment is completed, the authority may order supervision or placement measures. 為防衛自己或他人權利而對現在的不法侵害所為之行為,原則上不罰;若行為過當,則可能減輕或免除處罰。 為避免自己或他人緊急危難而不得已違警者,不罰;但如果行為過當,得減輕或免除處罰。 If someone is forced by human or natural force and cannot resist, they are not punished.
