性侵害犯罪防治法

This law is enacted to prevent sexual assault crimes and protect victims’ rights.

法院、檢察署、司法警察機關和醫療機構要由受過專業訓練的專責人員處理性侵害案件；這些人員每年至少要接受6小時專業訓練。

某些執行職務的人員發現疑似性侵害犯罪時，必須在24小時內向當地主管機關通報；通報內容與通報人身分原則上要保密。

直轄市、縣（市）主管機關在接獲前條通報後，如果知道行為人是兒童或少年，應依相關法規轉介權責機關提供相關服務。

網站平台、應用服務與接取服務提供者，在知道涉及性侵害犯罪嫌疑時，應先限制瀏覽或移除相關網頁資料，並保留相關資料180日。

醫療機構不得無故拒絕為被害人診療或開立驗傷診斷書。

知道或持有被害人身分資料的人，原則上要保密；警察必要時要採取保護被害人的安全措施；行政機關和司法機關公開的文書不得揭露被害人身分資訊。

媒體與其他人不得公開或報導可識別被害人身分的姓名或資訊，除非符合法定例外。

驗傷和採證原則上要經被害人同意，但在特定例外下可直接進行；證物要妥善封存、送鑑驗，部分案件還要由主管機關保管，六個月後可能銷毀。

被害人在同意下，特定親屬與專業/信賴人士可以在偵查或審判時陪同在場並陳述意見；兒童或少年被害人時，主管機關原則上應指派社工陪同。

兒童或心智障礙被害人在偵查或審判中，必要時要有相關專業人士在場協助詢問；專業人士也要先評估並向承辦人員說明，並可在特定許可下直接詢問被害人。

This provision defines key terms used in the law: sexual violence offenses, offender, victim, and professional.

前條專業人士在辦理協助詢（訊）問時，按其性質適用刑事訴訟法第十二章第二節、第三節。

The preceding two articles apply to juvenile protection events and juvenile criminal cases when the victim is a child or a person with mental disability.

對於心智障礙的犯罪嫌疑人、被告或少年，在刑事偵查、審判或少年事件程序中，必要時可以準用第十九條。

法院可以在法庭外訊問或詰問被害人，並可用科技設備或其他隔離措施將被害人與被告或法官隔離；特定被害人情況下，法院還必須採取這些措施。

In investigation or trial, the prosecutor or court may appoint an expert witness to give professional opinions; if the expert is summoned and testifies in court, that opinion may be used as evidence.

If the defendant or defense counsel makes gender-discriminatory statements or conduct toward the victim during trial, the court must stop it immediately.

Victim statements may be used as evidence in certain criminal cases if special trustworthy circumstances are shown and the statement is necessary to prove whether the crime occurred.

性侵害犯罪案件原則上不得公開審判；成年被害人同意且法院認有必要時例外。

地方主管機關可以在被害人申請後，核發特定補助；也可以訂定補助對象、條件、金額等自治法規。

加害人必須接受司法警察機關拍照、採指紋和採集DNA，不得拒絕；中央警政主管機關並須建立相關紀錄，且資料原則上應保密。

This provision defines the competent authority: at the central level, it is the Ministry of Health and Welfare; in a special municipality, the municipality government; and in a county or city, the county/city government.

必要時，中央目的事業主管機關可以依法律、條約、協定或協議，提供加害人的個人資料。

符合列舉情形且經評估有必要者，直轄市、縣（市）主管機關應命其接受身心治療、輔導或教育；執行期間原則上不超過三年，並可在特定條件下延長或停止。

經緩起訴處分確定的性侵害犯罪者，如經直轄市或縣市主管機關評估小組認定有必要，主管機關應命其接受身心治療、輔導或教育。

直轄市、縣（市）主管機關原則上要成立評估小組辦理相關評估；但服徒刑的成年受刑人、少年受刑人與受感化教育少年，改由監獄或少年矯正學校辦理。

觀護人可以對受保護管束的人採取多種處遇，包括約談、訪視、尿液採驗、住居限制、外出限制、測謊、科技設備監控、接近限制與轉介；部分措施需要檢察官許可。

對於受保護管束且接受科技設備監控的人，若故意拆除、損壞、隱匿或阻斷監控設備，檢察署通報警察後，司法警察官或司法警察得強制帶往檢察署或檢察官指定處所，並由檢察署派員恢復設備正常運作。

If an offender has received treatment, counseling, or education and is assessed as having a risk of reoffending, the local city/county authority may submit the assessment report to a prosecutor to seek compulsory treatment or continued compulsory treatment.

This provision allows correctional or prosecutorial authorities to ask a court to order compulsory treatment for certain offenders assessed as at risk of reoffending, and requires the local government authority to transfer ordered offenders to the treatment facility after sentence completion or receipt of the court order.

This provision sets time limits and review rules for compulsory treatment, allows court-approved extensions or stopping, and requires notice and transition planning near the end of treatment.

法務主管機關應會同中央主管機關，就前三條強制治療的申請、停止與延長、執行機關（構）、處所、執行程序、方式、經費來源、評估小組組成及其他相關事項訂定辦法。

This provision assigns different government authorities responsibility for sexual-violence-prevention related matters, including victim protection, treatment, education, labor support, police handling, immigration assistance, media handling, and household registration data.

法院在特定情形下應為加害人指定公設辯護人或律師，並在受理相關聲請時安排期日、通知相關人員，且給予到場者陳述意見的機會。

Certain offenders must register and report changes to the police, be available for police checks during the registration period, and update records within 7 days after changes.

Certain deferred-prosecution sexual offense offenders must register changes with police, accept police visits during the registration period, and report changes within 7 days; the rule does not apply if the person was under 18 when the offense was committed.

Certain registration items from the previous two articles may be made available for inspection to specified persons, and the central police authority is empowered to set implementing rules.

If a notified offender fails to appear on the specified date for compulsory treatment, they may be punished.

If someone breaches the confidentiality rule in Article 11(2), they are fined NT$60,000 to NT$600,000.

有違反特定規定且無正當理由者，目的事業主管機關可裁處新臺幣6萬元至60萬元罰鍰，並命限期改善；屆期未改善的，可按次處罰並限制接取。

違反保密規定者，會被處新臺幣6萬元以上、60萬元以下罰鍰。

Certain media-related violations can be fined, ordered corrected, and in some cases subject to seizure, removal, or repeated penalties.

違反第十四條第一項規定的人，會由直轄市或縣（市）主管機關處新臺幣一萬元以上五萬元以下罰鍰。

The central competent authority must carry out a range of sexual assault prevention tasks, appoint experts and representatives to provide advice, and may set rules for the handling of certain victim and offender data.

符合本條所列情形的人，主管機關可處罰鍰並命其限期履行；逾期仍不履行，還可能加重為刑事處罰。

地方主管機關在對特定人作出前條第一項處分後，應立即通知檢察官；檢察官接獲通知後，得進一步啟動撤銷假釋、聲請撤銷緩刑，或依職權撤銷緩起訴處分及易服社會勞動的程序。

警方可以公布通緝中逃亡或藏匿的被告、定罪加害人的身分資訊；但在其被拘提、逮捕、死亡或已无必要时，应立即停止公告。

戰時軍法機關處理現役軍人性侵害犯罪案件時，適用本法規定。

修法前已宣告強制治療的人，修法後要繼續執行；檢察官或地方主管機關要在修法後 6 個月內向最後裁判法院聲請裁定治療期間。

中央主管機關負責訂定本法施行細則。

Most of the Act takes effect on the date it is promulgated; Article 13 takes effect six months after promulgation.

地方主管機關必須整合相關機關人力，設立性侵害防治中心，並協調辦理被害人保護、加害人處遇與防治宣導等事項。

This article says certain cases and convictions are subject to specified other provisions by reference.

主管機關及目的事業主管機關應在其權責範圍內，依性侵害防治需要，尊重多元文化差異，主動規劃預防、宣導、教育及其他必要措施，並配合相關機關的防治業務。

高級中等以下學校每學期要開設至少 2 小時的性侵害防治教育課程；幼兒園要實施相關宣導；人數達 30 人以上的機關、部隊、學校、機構或僱用人，要定期辦理或督促人員參加訓練。
