本條說明「警察刑事紀錄證明」是什麼，指警察機關依司法或軍法機關已確定並執行的刑事案件資料所作成的紀錄證明。

符合條件的人可以向直轄市、縣（市）政府警察局申請核發警察刑事紀錄證明。

直轄市、縣（市）政府警察局在受理前條申請後，原則上應於三個工作日內核發警察刑事紀錄證明。

Police criminal record certificates must be in writing and state whether there is any criminal record, but certain listed records must not be entered.

申請人對警察刑事紀錄證明內容有異議時，可以書面附證明文件向原核發的警察機關申請查證；查證後若內容與事實不符，應予更正，若相符則不更正並通知申請人。

符合特定情形時，警察機關不核發警察刑事紀錄證明；並須書面通知原因，申請人可書面附證明申復。

直轄市、縣（市）政府警察局核發警察刑事紀錄證明時，應收取費用；費額由主管機關決定。
