民防法

本條說明制定本法的目的，並規定未另有規定時，適用其他有關法律。

This provision sets who may claim the bereavement payment, in what order, and how it is shared when several people are in the same rank.

各項給付的請領權，從可行使之日起二年內不行使就消滅；另有依本職身分規定者，依其規定。

主管機關在戰時、事變或緊急情況下，為民防需要，得簽發徵用命令，徵用特定土地、土地改良物、搶修與運輸工具及必要操作人員。

主管機關在戰時或事變時，因民防需要，可以協調地方衛生主管機關簽發徵購命令，徵購急救醫療用藥品、醫材及其他經行政院指定公告的民防必需物資。

徵用、徵購時，物資所有人或管理人要依命令指定的時間、地點交付物資；使用物資機關收到後要立即發給受領證明；必要操作人員要依徵用命令報到。

Certain supplies may not be requisitioned or purchased, including items owned by persons with diplomatic immunity, items needed by government agencies for official duties, items needed for basic daily life, and items later designated by the Executive Yuan.

The listed persons may not be requisitioned.

徵用物資的補償，依類型按規定給付；主管機關在特定情況下要修復損壞物資，不能修復或已毀壞、滅失時則解徵並按價值給付補償金。

主管機關應依徵用時的報酬標準，向依第十二條規定被徵用的操作人員給付補償；若因徵用而受傷、生病、失能或死亡，則依第九條的各項給付規定辦理。

主管機關應在徵購前，依市價和新舊程度評定徵購物資的價款；價款要在物資交付時一併給付。

This provision lists the scope of civil defense work.

物資徵用原因消滅時，主管機關應立即解除徵用，並按原交付地點返還徵用物資；操作人員也應一併解除徵用。

國防部為減少空襲損害，得會同有關機關實施防空演習，並命令疏散避難及交通、燈火、音響等必要管制。

國防部在戰爭發生或可能發生時，為防護空襲及支援軍事勤務，得協調中央主管機關及相關機關發布命令並執行相關管制與協助事項。

If a person violates the listed requisition or purchase orders, they may be punished with imprisonment, detention, or a fine.

Violations involving failure to organize, train, drill, serve, or support civil defense teams can be fined, with higher fines for repeated or continued noncompliance.

A person who refuses public leave under Article 8(2), or who violates an order made under Article 21, may be fined NT$30,000 to NT$150,000.

If a fine imposed under this Act is not paid by the deadline, it will be referred for compulsory enforcement according to law.

Civil defense work expenses must be budgeted for or borne by governments, agencies, schools, organizations, companies, and factories according to their nature.

本條規定本法適用於在中華民國領域內有住所、居所或財產的外國人或無國籍人，以及在境內有事務所或財產的外國法人等；但若條約、協定或其他法律另有規定，依其規定。

This provision defines the competent authority and says that peacetime civil defense work related to military service is supervised jointly with the Ministry of National Defense, while in wartime the Ministry of National Defense coordinates the use of civil defense teams to support military service.

中央主管機關負責訂定本法施行細則。

本條規定本法的施行日期由行政院以命令決定；修正條文原則上自公布日施行，但有一項特定修正條文改為自民國93年11月1日施行。

本條規定各級地方政府、特定公民營事業及一定規模以上機關等，應編組民防相關隊伍或防護團；相關編組、訓練與服勤辦法則由中央主管機關會同相關部會訂定。

本條規定哪些人員應參加民防團隊編組、訓練、演習與服勤，以及哪些主管機關可以制定相關辦法並在必要時協助重大災害搶救。

符合列舉情形的人，可以免參加民防團隊編組。

Certain persons may be exempt from joining civil defense team organization if the competent authority approves.

辦理機關（構）可按需要提供民防團隊編組人員訓練、演習或服勤時的膳宿、交通工具或代金，服勤期間也可發給津貼；其所屬機關、學校、團體、公司、廠場應給予公假。

參加民防團隊編組的人員，因訓練、演習或服勤受傷、失能或死亡時，可依本職身分規定請領給付；若不能依前項請領，則由辦理機關負擔醫療費、發給一次身心障礙給付或一次撫卹金，並在不足時補足差額。
