警察職權行使法

This provision says the law is enacted to regulate police exercise of authority lawfully and protect public rights, public order, and social safety.

警察在特定公共場所為維護治安需要時，可以協調相關機關（構）裝設監視器，或用既有攝影或其他科技工具蒐集資料；蒐集到的資料原則上須在製作完成後一年內銷毀。

警察在符合特定犯罪風險條件且經警察局長書面同意後，可以在一定期間內觀察並蒐集不涉及合理隱私期待的行為或生活資料。

Police may select a third person to secretly gather related information to prevent danger or crime, and the third person must not act unlawfully while doing so.

警察以第三人秘密蒐集特定人資料時，須先說明原因事實並經指定警察局長或分局長核准；蒐集結束後原則上要與第三人終止合作，但符合新原因事實、仍有蒐集必要且再經核准者，得繼續合作。

Police may orally or in writing state reasons and notify certain persons to appear, and must then immediately investigate or carry out forensic measures.

警察得定期查訪特定治安顧慮人口；內政部並負責訂定查訪的項目、方式及其他應遵行事項。

警察和其他機關在特定條件下可以互相傳遞個人資料；傳遞資料的機關要對資料正確性負責。

警察使用依法蒐集的資料時，必須限於法令職掌必要範圍，並符合蒐集資料的特定目的；法律另有特別規定的，不受此限。

警察依法取得且已不再有助於完成任務的資料，原則上應註銷或銷毀；這類資料也不得傳遞或作不利於被蒐集對象的利用。

警察在特定危險情形下可以對人實施管束，並須在危險結束時停止，最長不得超過24小時。

This provision defines “police,” “police powers,” and “police chief officer” for this law.

Police may use handcuffs or other approved restraints when necessary during lawful detention or control of a person, but may not use custody rules to force a statement during identity checks or questioning.

警察在為預防危害所必要時，可以扣留軍器、凶器或其他危險物品。

警察扣留物品時，通常要先製作並交付扣留物清單；若無法交付，則改做紀錄並說明理由。扣留物要妥善保管，必要時可委託他人保管或由處分相對人保管。

符合特定情形時，扣留之物可以變賣；某些情況下也可以不公開處置，不能變賣的則可以銷毀。

If detained property no longer needs to be detained, it should be returned to the owner, possessor, or custodian; if they are unknown, it may be returned to another person who can prove a right to it.

警察在天災、事變、交通危害或公共安全危害時，為達防護目的，得使用、處置或限制人民土地、住宅、建築物或物品的使用。

Police may enter a residence, building, or other place when there is an imminent threat to life, body, or property and rescue cannot be achieved without entry.

警察在行使職權、為排除危害時，可以暫時驅離妨礙的 人車，或禁止其進入。

Police may use statutory powers or other necessary measures to stop or remove ongoing danger to public safety, public order, or a person’s life, body, freedom, reputation, or property.

義務人或利害關係人可在警察行使職權時當場提出理由並表示異議；異議有理由時，警察應立即停止或更正，無理由時可繼續執行，且在請求時應交付異議理由紀錄。

警察行使職權時，不得超過達成目的所必需的限度，應採對人民權益侵害最少的適當方法，且不得以引誘、教唆犯罪或其他違法手段執行。

If police illegally exercise their authority and the State Compensation Act conditions are met, people may claim damages according to law.

人民因警察依法行使職權而遭受生命、身體或財產損失時，可以請求損失補償；補償以金錢給付為限，並限於實際特別損失。

This provision says the law takes effect on 1 December 2003.

警察行使職權時，應穿制服或出示證件表明身分，並告知事由；若未依規定行使職權，人民得拒絕。

警察因行使職權致人受傷時，應提供必要救助或安排送醫救護。

警察可以在公共場所或合法進入的場所查證特定人員的身分；進入公眾得出入的場所時，應在營業時間內進行，且不得任意妨礙營業。

警察為查證人民身分，可以攔停交通工具、詢問身分資料、要求出示證件；在特定情況下還可以檢查身體或攜帶物，必要時帶往勤務處所查證。

警察可以攔停有危害風險的交通工具，並要求查證身分、檢查車輛特徵、要求酒測，必要時可強制離車並檢查交通工具。

警察在特定情況下得以攝影、錄音或其他科技工具蒐集集會遊行等活動的現場資料；一般應在活動結束後立即銷毀，必要時可為犯罪或違法調查而保存。
