爆竹煙火管理條例

This provision states that the statute is enacted to regulate firecrackers and fireworks management, prevent disasters, protect life and property, and maintain public safety.

This provision lets the authority revoke a type approval for general fireworks in listed cases, requires the responsible person to recall the fireworks from production, storage, or sale locations, and bars a new type-approval application for two years after revocation.

進口待申請型式或個別認可的一般爆竹煙火時，申請人要向中央主管機關申請許可，並依類型補附文件；進口後還要送至合格儲存地點、通知地方機關封存，符合條件後才能申請解除封存。

販賣一般爆竹煙火時，不得使用自動販賣、郵購或其他無法辨識購買者年齡的方式。

兒童施放一般爆竹煙火時，父母、監護人或其他實際照顧兒童的人應陪同；中央主管機關也可以公告禁止兒童施放的爆竹煙火種類。

Importers of professional fireworks must submit specified documents to the central authority, store the fireworks in approved storage, and notify the local authority for counting before warehousing. Permit holders must report changes to their application. The central authority may revoke or cancel a permit and order destruction or re-export if the application data is false or the storage/change rules are violated.

一般爆竹煙火不得在列出的特定場所及其基地內施放；施放時還要和這些場所的外牆或相當設施保持標示的安全距離。

專業爆竹煙火與一定數量以下舞臺煙火的施放前申請、報備、運出儲存地點前備查及臨時儲存場所要求，均有明確程序。

Local municipal and county/city authorities may adopt local rules restricting where, when, what type, how, and by whom firecrackers may be set off, when needed for public safety and order.

爆竹煙火製造場所，以及達管制量三十倍的儲存、販賣場所，負責人要選任監督人，並辦理安全防護計畫與備查。

爆竹煙火製造、儲存或販賣場所在出現火災危險，或煙霧、異味、變質影響安定性時，負責人或爆竹煙火監督人必須立即採取緊急安全措施。

This article defines the competent authorities for fireworks regulation and divides fireworks safety powers between central and local authorities.

相關場所或輸入/販賣達一定數量化學品者的負責人，必須登記進出物料與貨物流向，保存紀錄至少五年，並在次月十五日前向地方主管機關申報前一個月紀錄。

地方主管機關可以進入爆竹煙火製造、儲存或販賣場所檢查；受檢者不得規避、妨礙或拒絕，檢查人員也要出示證件並不得影響正常營業。

相關場所的負責人必須投保公共意外責任保險；保險金額與施行日期由中央主管機關公告。

中央主管機關負責訂定專業機構認可申請、發給、撤銷、廢止、收費及其他應遵行事項的辦法。

Unauthorized manufacturing of fireworks and firecrackers is punishable, with heavier penalties if it causes death or serious injury.

在被命令停工或停業後，不得擅自復工或繼續營業；違反者，會被命令停工或立即停業，且負責人可能面臨刑罰與最高新臺幣一百萬元罰金。

Violations of this article are punishable by a fine of NT$600,000 to NT$3,000,000.

本條規定：發生列舉情形者，處新臺幣30萬元以上150萬元以下罰鍰；部分情形還要限期改善，逾期未改善者可按次處罰，並得停工或停業。

違反本條列舉的爆竹煙火管理規定者，得處新臺幣6萬元以上30萬元以下罰鍰。

If a person commits any listed violation, they are fined NT$30,000 to NT$150,000.

This provision defines “fireworks” and divides them into general fireworks and professional fireworks, with further subtypes.

If either listed violation occurs, the person is fined NT$3,000 to NT$15,000.

Certain applicants or traders may have their import or sale of potassium chlorate, perchlorate, or fireworks suspended by the central competent authority if specified violations occur.

主管機關必須沒入違規的爆竹煙火及相關成品、半成品、原料與器具；部分沒入物可變賣、拍賣給合法業者或銷毀，未有認可標示的成品、半成品則應先拍照存證並記錄數量後銷毀。

軍事機關自行使用的爆竹煙火、氯酸鉀或過氯酸鉀，在製造、輸入和儲存上不適用本條例；施放則仍依本條例辦理。海關依法應處理的爆竹煙火，其儲存也不適用本條例。

中央主管機關有權訂定本條例施行細則。

This provision says the statute takes effect on the date it is promulgated.

爆竹煙火製造場所及達管制量的儲存、販賣場所，其負責人必須以安全方法進行製造、儲存或處理。

申請爆竹煙火製造、儲存或販賣場所的建造，先要依建築法辦理並送審位置、構造、設備圖說；完工後還要會同消防機關檢查合格，才能核發執照。

製造爆竹煙火前，先向直轄市、縣（市）主管機關申請許可；核發許可文件後才可製造。

輸入或販賣達公告數量的氯酸鉀或過氯酸鉀，須先備齊資料向中央主管機關申請許可；輸入後要送到合格儲存地點，入庫前二天通知地方主管機關清點；運出儲存地點前也要先報請地方及目的地主管機關備查。

黑色火藥與導火索用於製造專業爆竹煙火時，相關購買、輸入、運輸、儲存、火藥庫設置或變更及安全管理，適用爆炸物管理規定。

一般爆竹煙火製造或輸入者，須先向中央主管機關申請型式認可、個別認可並附加認可標示，經檢查後才可在國內販賣。
