災害防救法

This law is enacted to strengthen disaster prevention and response, improve public awareness and response capacity, and protect life, bodily integrity, property, and national land.

鄉（鎮、市）、山地原住民區災害防救會報負責核定災害防救計畫與重要措施，並推動疏散安置、通報、搶通、復原重建、環境清理及其他依法令事項。

The township/city and mountain indigenous district disaster prevention and response office must handle the meeting’s affairs. The convener, deputy convener, and members are set out by role.

災害發生或有發生之虞時，地方首長應視災害規模成立災害應變中心並擔任指揮官；必要時，還可以成立前進指揮所。

重大災害發生或有發生之虞時，主管機關首長要決定中央災害應變中心何時開設及分級，成立後要立即報告召集人，召集人並指定指揮官。

Certain designated agencies, units, or public utilities must set up an emergency response team and carry out response measures when a disaster occurs or is likely to occur.

各級政府必須結合民防與全民防衛動員準備體系，並與相關學校、醫院、團體、公司、商業及有限合夥合作，辦理災害整備和應變；其實施辦法由內政部會商相關機關訂定。

內政部消防署特種搜救隊、訓練中心，以及直轄市、縣（市）政府的搜救組織與訓練單位，負責處理重大災害搶救等應變與訓練事宜。

中央災害防救委員會負責擬訂災害防救基本計畫，行政院核定後再函送相關機關與地方政府；行政院並應每年將災害防救白皮書送交立法院。

公共事業要依災害防救基本計畫擬訂災害防救業務計畫，送中央目的事業主管機關核定；中央災害防救業務主管機關也要依基本計畫，就其主管事項擬訂業務計畫，報中央災害防救會報核定後實施。

This article defines key disaster-related terms used in the law.

直轄市、縣（市）政府及鄉（鎮、市）、山地原住民區公所，須依上位計畫與災害潛勢擬訂地區災害防救計畫，並依規定核定、備查；前述地方計畫不得牴觸上位計畫。

If disaster prevention plans conflict and the conflict cannot be resolved, the matter must be reported to the Central Disaster Prevention Commission for coordination.

各級政府應依權責實施減災事項；公共事業應依其災害防救業務計畫辦理減災；相關公開資料辦法由中央災害防救業務主管機關定之。

多類機關、學校、醫院、團體與企業須辦理災害防救訓練、演習；各級政府須推動防救災教育宣導，並在需要時提供相關教材與公假。

各級政府及公共事業應設置專職人員；鄉（鎮、市、區）及山地原住民區公所未設專職人員前，可以先設兼職人員辦理災害防救工作。

各級政府要依職責實施災害應變措施；公共事業要依其災害防救業務計畫辦理相關應變；危險建築物緊急評估的辦法由內政部訂定。

災害應變中心成立後，相關機關首長要到場或派有權人員進駐執行應變工作；各級中心要有固定場所、設備和定期演練；必要時還要異地設置備援中心。

民眾發現或懷疑有災害時，應立即通報消防、警察、村（里）長或村（里）幹事；受理通報的人員或單位要迅速採取必要措施。

This article assigns central disaster-response authorities for different disaster types and gives them coordination, planning, support, handling, and resource-integration duties.

災害應變中心成立後，指揮官可在災害應變範圍內執行多項救災與管制措施，相關處分有些還必須公告；對部分處分，任何人不得規避、妨礙或拒絕。

Governments may requisition, buy, or require custody of necessary disaster-relief supplies from specified businesses, and may inspect business premises or storage locations using personnel with proof documents. No one may evade, obstruct, or refuse these actions.

各級政府可以為依本法執行災害防救事項的人員、受徵調的相關專門職業或技術人員，以及所徵用物資的操作人員投保相關保險。

內政部負責訂定徵調、徵用、徵購或優先使用相關的作業程序、補償基準、給付方式及其他事項辦法。

人民因特定處分、強制措施或命令受損時，可以向執行機關請求金錢補償，但若損失可歸責於自己，則不適用。

地方政府或災害主管機關無法處理災害時，中央層級機關或國軍須提供協助；國防部也可運用後備軍人支援救災。

中央災害防救業務主管機關要擬訂緊急應變警報訊號的種類、內容、樣式、方法和發布時機，報請行政院核定後公告；未經許可不得擅自使用前項或類似訊號。

各級政府要依權責辦理災後復原重建事項；相關事項也要納入各級災害防救計畫。公共事業則要依其災害防救業務計畫，辦理有關災後復原重建事項。

各級政府可以調派人員組成災後復原重建的任務編組委員會；委員會須在全部重建完成後才能解散；解散時，政府要指定後續計畫檢討與變更的主管機關。

各級政府在災害造成交通中斷或公共設施毀壞、且有危害民眾之虞時，為立即搶通或重建，得簡化行政程序，並可不受特定法律或法規命令限制。

This provision names the competent authority and assigns disaster-prevention local affairs to local governments and township/district offices.

發生災害、影響受災地區居民正常生活時，各級政府為安置受災民眾或推動重建，得簡化涉及用地與建築物事項的行政程序，並可不受相關法律或法規命令限制。

中央災害防救委員會應協調金融機構，提供受災地區民眾重建或修繕所需的低利貸款。

災區受災居民在符合災損認定並經原貸款金融機構同意時，可以用自用住宅及土地抵償原貸款；內政部也可以提供利息補貼，並另訂相關辦法。

金融機構可為災區受災居民延長既有借款和信用卡的本金及應繳款期限，延長期間不得計收利息，並由中央政府補貼利息。

災區受災居民領取的救助金、慰問金或臨時工作津貼免納所得稅；符合條件的災區土地及建築物可減免地價稅及房屋稅。

This provision requires the central government to pay specified disaster-related health insurance costs for affected insured persons, and it lets the Ministry of Health and Welfare designate special treatment areas and set related rules.

災區受災的特定保險被保險人，其災後一段期間內應負擔的保險費由中央政府支應；勞工保險被保險人因天然災害致傷病者，得請領傷病給付，相關經費也由中央政府支應。

A disaster-area low-income household that has not applied for government preferential financing or other subsidies may receive an interest subsidy on a startup loan, and the loan amount may not exceed NT$1.5 million.

If disaster-area agricultural collateral is totally destroyed or lost, the financial institution may take it over up to the loan balance. The government must subsidize that takeover amount up to 80%, and the Agriculture Ministry sets the related rules with the FSC.

災區受災企業因受影響而營運困難時，中央目的事業主管機關得協處；相關辦法由主管機關擬訂並報行政院核定。

中央災害防救業務主管機關為達災害防救目的，得採取必要的法律、行政及財政金融措施，並向立法院報告。

災區受災民眾提起相關民事訴訟時，暫時不用繳裁判費；申請強制執行時也暫時不用繳執行費。

本條定義「災區」為因災害造成嚴重人命傷亡或建物毀損等的受創地區，並由行政院公告且刊登政府公報來決定其範圍。

符合本條件的災民住宅，不得被作為強制執行的標的。

During a disaster, intentional theft, fraud, extortion, robbery, or aggravated robbery may be punished more severely. Knowingly filing false disaster-related reports is fined, and spreading disaster rumors or false information can lead to imprisonment, detention, or fines; if death or serious injury results, the penalties are harsher.

If a person falls within one of the listed situations, they are subject to a fine of NT$100,000 to NT$500,000.

If any listed act occurs, a fine of NT$50,000 to NT$250,000 may be imposed.

If any listed situation occurs, a fine of NTD 30,000 to 150,000 applies.

各級政府應依法編列災害防救經費；不足時，得依需要調整當年度收支支應，且在特定情形下不受預算法部分限制。

經費不足以支應重大天然災害災後復原重建時，鄉（鎮、市）、山地原住民區公所得向上級縣市政府請求補助；直轄市、縣（市）政府則得向中央政府請求補助。

政府統籌處理民間捐贈救災款項並辦理災害應變、復原重建時，應依公益勸募條例規定辦理。

行政院設中央災害防救會報，並由其負責決定、核定、督導與推動災害防救相關事項。

各級政府應依法令表彰對全民防救災教育有傑出貢獻或顯著功勞的機關、團體、志願組織或個人。

執行本法災害防救事項的人員可以另領津貼；因傷病、身心障礙或死亡時，可依規定請領醫療、障礙或撫卹給付。

對於因災害失蹤且有事實足認已因災死亡、但屍體未發現的人，法院可依利害關係人或檢察官聲請，確定其死亡及死亡時間。

中央災害防救業務主管機關在會商直轄市、縣（市）政府後，統一訂定災害救助的種類、方式、基準及其他相關標準。

協助執行災害應變措施的災害防救團體或志願組織，必須向直轄市、縣（市）政府申請登錄；已登錄者，各級政府應投保救災意外險，並可協助提供救災設備。

內政部負責訂定本法施行細則。

This law takes effect on the date it is promulgated.

This provision sets up disaster-prevention bodies under the Executive Yuan, assigns their heads and members, and gives them coordination, advisory, and search-and-rescue functions.
