原住民身分法

本條說明本法是為了認定原住民身分並保障原住民權益而制定。

戶政事務所負責受理原住民身分取得、喪失、變更或回復的申請，審查符合規定後辦理戶籍登記，並在登記後生效。

If someone was wrongly registered as indigenous status or left unregistered for that status, the local household registration office must notify the person in writing and handle revocation or correction; the person may also ask the office to investigate and make the correction.

This law takes effect on the date it is promulgated.

This article defines who counts as “indigenous peoples” under the law, and sets the conditions for recognizing “mountain indigenous” and “plains indigenous” status.

A person with an indigenous parent acquires indigenous status if they meet one of the listed name or surname conditions; a child of someone who qualified under item 2 also acquires that status if the child takes that parent’s surname.

符合條件的被收養非原住民，可以取得原住民身分。

This provision says when a person loses indigenous status, allows a limited application to recover it, and protects the status of certain lineal descendants.

申請取得原住民身分時，當事人可以申請採用原住民族傳統名字、原住民族文字並列名字，或從父母中具原住民身分者的姓；未成年由法定代理人以書面約定申請，成年後由本人依意願申請。

If a person who met the requirements to obtain indigenous status dies before applying, that person’s children may obtain indigenous status under the referenced rules.

山地原住民與平地原住民結婚時，可以約定改變為相同的原住民身分；在未作此約定時，子女未成年時可由法定代理人協議，成年後可依本人意願取得身分。

原住民要依父或母所屬民族登記民族別，且其傳統名字或從姓要與已登記的民族別相連結。
