原住民保留地禁伐補償條例

This provision states that the statute is enacted to address compensation for no-logging on indigenous reserved land and to support land protection, water conservation, environmental greening, ecosystem conservation, climate-change response, and disaster reduction.

執行機關可以每年辦理禁伐補償宣導、提供森林維護與病蟲害防治建議，並且應諮商原住民對禁伐補償的意見。

This provision identifies the authorities for this Act: the competent authority, the executing authorities, and the receiving authority.

符合條件的原住民保留地所有權人或合法使用權人，可以申請禁伐補償。

申請人每年要向受理機關提出禁伐補償申請並附文件；符合特定條件時可免附部分文件，但同一地號土地當年度只能擇一申請相關補償或補助。

原住民保留地只要符合列出的任一條件，主管機關就要劃定為禁伐區域並公告。

This provision sets the per-hectare amount of forest compensation and says the amount is adjusted every two years from 2024 onward, unless the relevant growth rate is zero or negative.

核發禁伐補償金後，如果發生列舉情形，地方執行機關應撤銷補償，並命受領人按月按比例返還當年度補償金。

符合條件的繼受人可以按月、按面積比例領取禁伐補償金；公有原住民保留地的合法使用權人也適用同樣規定。

主管機關、中央執行機關和地方執行機關都必須建立或執行與禁伐補償、森林資源清查監測及資料庫建置有關的工作。
