平埔原住民族群身分法

This provision states the Act’s purpose: to recognize Pingpu Indigenous ethnic groups and protect Pingpu Indigenous identity recognition rights.

中央主管機關審議特定申請案時，必須組成審議會並依審查基準辦理；審議會有人數、性別比例、出席與同意門檻，且在作成結果前要先聽取申請人等意見。

中央主管機關應將前條第一項的審議結果報請行政院核定，並通知申請人、刊登政府公報及在機關網站公開，讓外界周知。

主管機關要公告平埔原住民族群成員身分認定要件五年；符合條件者可在公告期間向直轄市、縣（市）主管機關申請登載名冊，該機關原則上二個月內處理。

符合條件者得申請取得平埔原住民族群成員身分；先前已提出但尚未核定的申請，則依第六條至第十二條辦理。

第十二條規定名冊內的人，可以依第二十一條規定申請取得平埔原住民身分。

符合特定條件的平埔原住民父或母，可以取得平埔原住民身分；若其子女隨其姓，子女也應依同款規定取得該身分。

符合條件的當事人得取得平埔原住民身分。

This provision says when a person loses Pingpu Indigenous status, when status may be restored, and that a child’s status is not lost because the parent applies to give up status.

本條規定，為取得平埔原住民身分，當事人要依本法採用或並列平埔原住民族群的傳統名字或從姓；未成年者由法定代理人以書面約定申請，成年後則可依個人意願申請。

平埔原住民的身分別原則上不得依法律規定以外的方式變更；父母身分別不同時，未成年子女可由法定代理人書面約定，成年後可依本人意願登記或變更。

This provision defines the competent authority differently depending on location.

平埔原住民要依父或母所屬的平埔原住民族群登記民族別，且其傳統名字或從姓要與已登記的民族別相關聯。

戶政事務所受理平埔原住民身分取得、喪失、變更及回復的申請；審查符合規定後，應在戶籍資料中登記身分別及民族別，並於登記後生效。

政府要維護、保存並發展平埔原住民族群文化；規劃政策或區域發展時要評估文化衝擊並確保其權益與發展。

政府應在本法施行後三年內，考量平埔原住民族群及其成員的歷史與現況，以及國家資源分配，制定或修正相關法律來保障相關權利。

This law takes effect on the date it is promulgated.
