財團法人客家公共傳播基金會設置條例

This provision states that the statute is enacted to establish the Hakka Public Communication Foundation.

董事、監察人任期三年，且只能連任一次；出缺時由主管機關補聘，補聘者任期到原任期屆滿為止。

董事與監察人原則上是無給職；董事長若屬專任，則例外為有給職。

本條規定董事會的職權、會議頻率，以及一般決議與特定事項決議的出席與同意門檻。

監察人負責監督、審核與稽核指定事項，並可列席董事會陳述意見。

Certain listed persons may not serve as directors or supervisors of the foundation.

董事、監察人必須遵守利益迴避，不得利用職務權力、機會或方法圖謀自己或關係人的利益。

If a director falls into any listed disqualifying situation, the competent authority must report to the Premier for dismissal.

The foundation must have one general manager. The chair recruits and proposes the appointment, the board appoints with the required attendance and vote, and the general manager is supervised by the chair, performs the foundation’s business, and is subject to several conflicts-of-interest and outside-activity bans.

董事會在總經理符合列舉情形時，應予解聘；總經理若違反法令、章程或前述情形並致基金會受損害，應負損害賠償責任。

主管機關訂定本基金會捐助章程；變更時由董事會先擬訂，再報請主管機關核定。

本基金會的設置要依本條例規定；本條例沒有規定的部分，適用民法及相關法律。

本基金會的會計年度必須與政府會計年度一致。

本基金會編列預算、辦理決算與處理年度賸餘時，應依指定程序報主管機關辦理。

本基金會必須建立人事、會計、內部控制及稽核制度，報主管機關核定，並將指定經營文件備置於基金會及公告於網路供民眾查閱。

本基金會每年要邀集相關團體、學者及專家，就發展規劃與公共資源運用舉辦公聽會或諮詢座談會，並提出績效報告及改進說明送立法院備查。

主管機關在本基金會符合特定情形時，可以解散它；解散後，剩餘財產歸國庫。

This provision says the regulation takes effect on the date it is promulgated.

本基金會的主管機關是客家委員會。

本基金會可以委託無線廣播、電視機構播送客家廣播與電視節目及廣告，並可在設立時使用原屬客家委員會廣播電臺的執照與頻率。

本條規定本基金會的創立基金為新臺幣五千萬元，並允許主管機關在設立時依業務需要捐贈其經管的國有公用動產及權利；若該等權利屬智慧財產權，主管機關還可基於客家文化發展需要無償運用。
