國際合作發展基金會設置條例

This provision establishes the International Cooperation and Development Fund Foundation and states the statute is enacted to support international cooperation, external relations, economic development, social progress, and human welfare.

基金會設監事3至5人，由行政院院長遴聘；其中1人為常務監事。

本基金會要設秘書長1人、副秘書長2至3人，由董事長提名、董事會同意後聘任。秘書長受董事會指揮監督，負責統籌會務；副秘書長協助會務。

本基金會可以設置諮詢委員會，並由董事長提請董事會通過後聘請7至11名諮詢委員。

本基金會辦理國際合作發展事務時，可採技術協助、能力建構、投資、貸款、保證、捐款、實物贈與、人員派遣、發展策略諮商及其他可行方式。

本基金會的會計年度必須與政府會計年度一致。

本基金會在會計年度開始前要先訂工作計畫、編預算，經董事會通過後報主管機關；年度終了時要把工作成果和收支決算經監事審核後報主管機關辦理。

本基金會應定期向立法院提出工作報告。

主管機關應擬訂本基金會關於技術合作、貸款、投資、保證、捐款及贈與等事項的處理辦法，並報請行政院核定。

主管機關 must draft the foundation’s donation charter under the Act and related laws, then submit it to the Executive Yuan for approval.

主管機關要編列預算照顧本條例施行前已從事海外技術服務的人員；其他法律另有規定者除外。

If the foundation’s circumstances change so it can no longer achieve the purpose set by this statute, it may dissolve; after dissolution, it must liquidate according to law and any remaining property goes to the treasury.

本基金會是財團法人；其設置依本條例規定，未規定的部分適用其他法律。

本條例自公布日起施行。

本基金會的主管機關是外交部；如果業務涉及其他部會職掌，外交部要商同相關部會辦理。

本條規定基金會的設置來源，以及該基金會承受相關資產、負債、債權與債務，且不受預算法第二十三條限制。
