駐外機構組織通則

This provision states that the general rules are issued to clarify the organizational structure of overseas institutions and to manage the use of foreign affairs resources.

外交部及各機關得按駐外機構實際需要，依聘用人員聘用條例聘用專門人才，但合計員額不得超過駐外機構總預算員額的百分之三。

駐外機構在需要時，可以依駐在國勞工法令遴用當地專業人員和當地僱用人員協助館務。

在未設駐外機構的國家或城市，可以遴派名譽領事；其資格、條件、職務範圍及其他相關事項，由外交部訂定辦法。

Certain central government agencies outside the Executive Yuan may, after coordinating with the Ministry of Foreign Affairs, set their own staffing table and assign staff to related internal units of overseas missions.

行政院以命令訂定本通則的施行日期；修正條文自公布日起施行。

This provision defines what counts as a “驻外機構” and allows central administrative agencies other than the Ministry of Foreign Affairs to set up attached offices at overseas missions after consulting the Ministry and getting Executive Yuan approval.

外交部是本通則的主管機關；駐外機構的設立、調整、裁撤及轄區劃分，需由外交部報請行政院核定。

駐外機構可以分單位辦事；其內部單位要按業務繁簡平衡設置。

駐外機構館長、各級副館長及駐外人員的職責與指揮監督關係，還有外交部的指定與調整職務權限。

外交部可因業務需要，給予駐外人員適當對外名義或加銜。

各機關辦理派駐外機構主管或職務最高人員的任免遷調前，應先徵詢外交部意見；其他派駐人員的任免遷調，則應通知外交部。

外交部駐外人員奉調返國時，原則上可以回外交部及所屬機關（構）按原職務辦事；但若已改任組織法規定的職務，則不適用。
