護照條例

Passport application, issuance, and management are handled under this Act.

This provision lists who is covered by a public passport.

本條規定不同種類護照的效期上限，以及主管機關可在上限內酌定效期；護照效期屆滿後不得延期。

主管機關可會商相關機關，訂定尚未履行兵役義務男子護照的效期、戳記、換發、補發、僑居身分加簽限制及其他應遵行事項。

內植晶片之護照，其晶片應存入資料頁記載事項及持照人影像。

外交護照和公務護照免費；普通護照一般要收規費，但因公務需要並經主管機關核准者除外。

護照申請原則上可由本人或代理人辦理，但某些情形必須本人親自辦理，且特殊原因下可經主管機關同意後改由代理人辦理。

未成年人申請護照時，依年齡與是否受監護宣告，須由法定代理人書面同意或代為申請；若法定代理人有二人以上，任一人可辦理。

If needed, passport entries other than the data page may be applied for as endorsements according to the rules.

護照申請人不得與他人合領一本護照；持照人原則上不得同時持用超過一本護照，但如有特殊理由並經主管機關核准則例外。

符合特定情形時，護照持有人應申請換發；另有幾種情形下可以申請換發。

本條例的主管機關是外交部。

持照人護照遺失或滅失時，可以申請補發；一般補發後的效期是五年。

護照申請有特定問題時，主管機關或駐外館處可以通知申請人補正或到場說明，並可延長處理期間；在特定情形下，也可以縮短護照效期。

外交或公務護照持有人在持用事由消失後，原則上要依主管機關通知期限繳回護照；經核准可繼續持用者除外。

有特定情形的護照申請人，主管機關或駐外館處應不予核發護照。

主管機關或駐外館處在特定情形下應扣留持照人的護照；偽造護照不論屬於誰，均應沒入。

在特定情形下，主管機關或駐外館處應撤銷、廢止或註銷護照及其核發處分。

駐外館處在特定情況下，可以發給已出國且在臺設有戶籍的國民短期返國護照或入國證明書。

主管機關或駐外館處依第二十二條至第二十五條作成處分時，原則上應以書面為之。

主管機關可訂定護照扣留、沒入、保管的保管期限、註銷、銷毀方式及其他應遵行事項辦法。

If conduct involving a passport is serious enough to harm the public or others, the offender faces 1 to 7 years’ imprisonment and may also be fined up to NT$700,000.

主管機關有權製定護照。

Anyone who for passport misuse purposes forges, alters, obtains by false claim, uses, transfers, reports as lost, or impersonates identity in a passport application may be punished with imprisonment up to 7 years and an additional fine up to NTD 700,000.

Anyone who gives a passport to another person, falsely reports it lost for someone else’s impersonation, or impersonates another person using their passport may be punished with up to five years’ imprisonment, detention, or a fine of up to NT$500,000, or both.

A person who unlawfully keeps someone else’s passport or uses a passport as security for a debt or claim, and whose conduct can harm the public or another person, may be punished with imprisonment, detention, a fine, or both.

A person who commits offences under Article 29 to the preceding article outside the territory is punishable under this statute, even if the place where the offence occurred does not punish that conduct.

行政院設立或指定的機構，或受委託的民間團體，在辦理護照業務時，適用本條例的規定。

主管機關為辦理護照核發、補發、換發及管理作業，得向相關機關取得特定資料；相關機關不得拒絕提供。

If a person married before the amendment and is still under 18 after it takes effect, the pre-amendment rule continues to apply until they turn 18.

主管機關可以訂定本條例的施行細則。

本條例的施行日期由行政院決定。

This article defines “passport” and “dependents.”

持照人必須妥善保管並合法使用護照；只有持照人可依指示在填寫欄填寫資料並簽名，非權責機關不得擅自增刪、塗改或加蓋圖戳。

護照適用於具有我國國籍者；具有大陸地區人民、香港居民、澳門居民身分者，在身分轉換為臺灣地區人民前，原則上不適用，但經主管機關許可者例外。

This provision says passports are divided into diplomatic passports, official passports, and ordinary passports.

主管機關核發外交護照和公務護照；普通護照由主管機關或駐外館處核發。
