華僑身分證明條例

This provision states that the law is enacted to govern issuing overseas Chinese identity certificates and processing passport endorsements for overseas Chinese residence status.

Eligible overseas nationals with ROC ordinary passports may apply for an overseas-resident endorsement on the passport. Men near conscription age or of conscription age who have not yet completed military service may be subject to limits.

If a passport with an overseas compatriot status endorsement is being reissued or replaced, and the overseas residence proof is still valid after verification, the status endorsement may be transferred again.

持有僑居身分加簽護照的人，在護照有效期間內，其加簽效力與華僑身分證明書相同。

Minors aged 7 to under 18 need their legal representative’s written consent to apply for the listed certificates/endorsements; minors under 7 or persons under guardianship must have the legal representative apply for them.

主管機關受理申請核發華僑身分證明書時，應收取證明書費；費額由主管機關決定。

主管機關負責訂定華僑身分證明書的格式及應記載事項。

主管機關為辦理華僑身分證明書核發或僑居身分加簽事項，得商請內政部及外交部提供相關資料。

主管機關負責訂定本條例的施行細則。

This provision states when the statute takes effect: the statute applies from the date it is published, and the amended text from December 29, 2020 applies from January 1, 2023.

The competent authority for this statute is the Overseas Community Affairs Council.

本條例適用於僑居國外國民，但具有大陸地區人民、香港居民、澳門居民身分，或持有大陸地區所發護照者，不適用。

符合條件的僑居國外國民可以申請華僑身分證明書。

申請華僑身分證明書的人，必須向主管機關提出申請並檢附規定文件。

主管機關在核發華僑身分證明書時，應記載申請人是檢附華裔證明文件申請；該證明書的實質效力，由各目的事業主管機關依職權認定。

主管機關可因僑居地特殊需要，委託駐外館處受理華僑身分證明書申請，並由主管機關訂定受理程序及其他應遵行事項的辦法。

華僑身分證明書的效期自核發日起算為一年。

If an overseas Chinese identity certificate is lost or damaged, the holder must apply again.
