後備軍人會組織通則

This provision states that the regulation is made under Article 28 of the Military Service Act.

This provision sets the number of directors and supervisors for county/city and township veterans associations, how they choose their chairpersons, and their term of office.

縣（市）後備軍人會及分（支）會可以設置組織、輔導、總務三組；總幹事和幹事的人選由理事長提名，經理事會通過後聘任。

縣（市）後備軍人會為執行本通則第三條所列任務，得設各種委員會，並得視任務需要將會員編為小組。

The Ministry of National Defense is the central supervisory authority for reserve soldiers’ associations, and a Central Reserve Soldiers Guidance Committee is established. The Executive Yuan sets the committee’s organization rules.

中央後備軍人指導委員會應於每年年初前，依規定並考量後備軍人實況，製訂後備軍人會年度工作大綱，並由國防部核定後實施。

軍管區司令部是轄區後備軍人會的指導機關，並應報請國防部核准設立後備軍人指導委員會；其組織規程由行政院定之。

省（市）區後備軍人指導委員會要依中央年度工作大綱和轄區情況，制定轄區後備軍人會年度工作計畫，並經軍管區司令部核定後轉頒實施。

This provision assigns the competent authority for county/city reserve military personnel associations: the district defense command handles military construction support, mobilization draft work, military research, and physical training; the county/city government handles all other matters.

The defense ministry must approve the convening of reserve personnel representative assemblies, and it sets the convening rules.

後備軍人會的經費來源包括會員會費、會員樂捐、政府按月補助，以及在辦理福利或救濟時對外募捐；對外募捐前要先擬定辦法並報主管機關核准。

後備軍人會的組織依本通則規定；本通則沒有規定的部分，依一般人民團體組織法及其他相關法令辦理。

國防部及省（市）縣（市）政府應為後備軍人會補助費編列預算；後備軍人會的經費開支，除經監事會審核外，應依法報請核銷。

後備軍人違反本通則時，主管官署得對其處以警告、撤銷其決議或整理。

縣（市）後備軍人會的會址，可以設在縣（市）政府內。

後備軍人會應訂立會章，並向當地政府備案，另分呈同級管區。

This provision says the General Provisions takes effect on the date it is promulgated.

後備軍人會應依國防部指示，協助軍事建設與徵召動員，並負責輔導會員學術、體能、守法重紀、就業、福利互助與災難救濟。

Certain reserve military personnel must join the local reserve military association as members.

已失去後備軍人身分的人，不得參加後備軍人會；已加入者，應註銷會員資格。

後備軍人會會員可享有本會相關權利，包括選舉與被選舉權、建議權、福利及救助的享受權，以及依法應享的其他權利。

後備軍人會會員有義務遵守會章、執行決議、接受指派工作、繳納會費，並履行其他依法應盡的義務。

This provision sets the naming and organizational structure for reserve military personnel associations, branches, and direct groups based on local or workplace membership counts.

A county/city reserve military personnel association may be started by at least 15 reserve military personnel, but only after applying to the local county/city government for permission.
