國軍軍事勤務致人民傷亡損害補償條例

This provision says the statute is enacted to handle compensation for injuries to people or damage to property caused by military service duties.

核定的補償金如果自申請人收受通知日起逾二年未領取，該補償金歸屬國庫。

申請補償金的權利，從本條例施行日起算二年後消滅；如果期限屆滿後仍有人尚未申請，期限再延長六年。

補償金所需經費由國防部依預算程序辦理。

國防部負責訂定補償金申請、審核及發放作業規定。

This provision says the law’s commencement date is to be set by the Executive Yuan, and any amended provisions take effect on the date of publication.

臺灣地區人民在指定期間內，因國軍軍事勤務造成傷亡或財物損害者，可以依本條例申請金錢補償；但若同一事由已經從其他途徑取得賠償、撫卹或其他慰撫及補償，就不再補償。

This provision defines “國軍軍事勤務” as military duties performed by active-duty personnel, except wartime duties, and says the Executive Yuan sets its scope.

國防部為處理本條例補償事宜，應設置國軍軍事勤務致人民傷亡損害補償委員會。

補償委員會由指定官員和代表組成；其編組及實施要點由國防部報請行政院核定。

Compensation is calculated in base units: each base equals NT$50,000, with a cap of 30 bases for injury or death compensation and 60 bases for property-loss compensation.

申請補償金時，申請人或死亡者遺屬要附證明文件，向事故發生地的直轄市、縣（市）政府提出申請。

This provision sets the order of eligible heirs and how they receive the compensation if there are multiple heirs in the same order.

If the compensation committee has doubts about a city or county government’s investigation/appraisal, it may order or ask for a new investigation/appraisal. If the claim meets the compensation rules, it must determine the compensation base amount; if not, it must reject it in writing with reasons.
