國防法

行政院所屬各機關要依國防政策推動國防科技工業，採購武器裝備時以自製優先並落實技術轉移；國防部可以合作、委託國內外法人團體辦理相關研發、產製、維修、銷售，也可以委託民間經營相關機構與設施。

行政院得核准為國防安全需要而興建緊急性或機密性國防工程或設施；各級政府機關應配合辦理。

The President may issue an emergency order for defense needs and set mobilization matters, including nationwide or local mobilization.

The Executive Yuan may designate competent authorities to set stockpiling levels, prepare mobilization plans, and conduct drills. During drills, it may requisition or purchase property and use the personnel operating it, and requisition must be compensated appropriately.

行政院應指定機關統籌辦理動員及動員準備事項。

在戰事已發生或可能發生、且為因應國防緊急需要時，行政院及所屬機關得依法徵購或徵用物資、設施或民力。

行政院得依法成立民防組織，並實施民防訓練及演習。

中央及地方政府各機關應推廣國民國防教育，增進國防知識與防衛意識，並依職權積極規劃處理國防所需資源。

This provision says Taiwan’s national defense is all-of-society defense and includes military defense, civilian defense, disaster prevention and relief, and related political, social, economic, psychological, and technological matters that directly or indirectly help achieve defense goals.

國防部應定期提出國防報告書；在國防政策有重大改變時，也應適時提出。

國防部必須定期向立法院提出國防相關報告，並在每年與總預算書一併送交特定年度報告；總統就職後十個月內，還要公開提出四年期國防總檢討。

從事或參與國防安全事務的人員，必須接受安全調查；國防部負責訂定該調查的內容與程序。

Foreigners may serve in the Republic of China military only with permission from the Ministry of National Defense and the Ministry of the Interior. Matters about allied countries’ troops or military personnel stationed in Taiwan are to be set by treaty or agreement.

本法的施行日期由行政院在本法公布後三年内决定。

Taiwan’s national defense military force consists of the army, navy, and air force. During wartime, the Ministry of National Defense may ask the Executive Yuan for permission to use other armed teams established by law in the combat sequence.

中華民國陸海空軍應遵守憲法，效忠國家，愛護人民，並盡職責以確保國家安全。

現役軍人及中華民國陸海空軍須保持政治中立，且現役軍人不得擔任政黨、政治團體或公職候選人提供的職務，也不得強迫其他現役軍人參與相關活動或在軍事機關內部建立政治性組織。
