陸海空軍軍官士官任官條例

陸海空軍軍官、士官的任官，依本條例規定辦理。

軍官、士官在預備役期間，符合貢獻或召集表現良好條件時，可以辦理預備役晉任。

軍官、士官若對國家有勳績或死事壯烈，得於身後追晉或追贈官階，且不受第四條、第六條或第七條限制。

上校以下軍官和士官轉任前，須先完成他軍種或官科專長教育合格；轉任後，未經核准不得回復原軍種官科。

This provision says officers may be appointed if they meet one of the listed conditions, and enlisted noncommissioned officers may be appointed if they meet one of the listed conditions and, as needed for authorized strength or supplementing vacancies, be assigned an appropriate rank.

符合本條例規定的女子，可以被任官。

軍官、士官在特定情形下會被免官；原因消滅後，得核予復官。

軍官、士官受降階懲罰時，其俸級改按原任官階換敘為次一官階相當俸級；如次一官階沒有相當俸級，則換敘為該官階最高俸級。

軍官任官由國防部審定，並報請行政院轉呈總統任命；士官任官由特定機關、部隊或學校審定，並依隸屬系統報國防部或各司令部任命。

本條例自公布日施行；至於中華民國一百零八年十一月十九日修正之第十五條之一，其施行日期由行政院決定。

士官在遂行戰鬥任務、且為作戰需要時，可以辦理戰場直接晉任少尉；此規定稱為戰場晉任，且不受第四條限制。
