軍人待遇條例

現役軍人的待遇，依本條例規定。

Approved reserve military personnel are to receive benefits according to their new rank starting from the effective date of recall to active service or voluntary re-service.

This provision sets pay rules for missing or suspended active-duty military personnel and related beneficiaries.

現役軍人或現役軍官、士官在停役、免官或留職停薪期間，待遇停止發給；回役或復官後，依核定情形恢復支給，部分情形可補發停役期間本俸。

Demoted active-duty military personnel must be paid at the lowered salary grade, or if no lower grade exists, their pay must be reduced by the corresponding pay difference.

後備軍人依法召集服現役期間的給與，由國防部擬訂，並報請行政院核定。

現役軍人的待遇，發到退伍、解除召集、停役、免役、禁役或除役的人事命令生效前一日為止。

對現役軍人逃亡者，依第三條第二項的計算方式，扣除或追繳其未就職役日數的待遇。

Volunteer active-duty military personnel may request a re-determination of pay grade after approval if they object, and may request once more within one year if new evidence appears.

行政院負責訂定派駐駐外機構之現役軍人的待遇項目及數額。

本條例的施行日期由行政院 तय定。

This article defines several military pay and personnel terms.

現役軍人的待遇分為本俸和加給，原則上按月計算；未滿整月的現役期間則按實際服役日數計支，死亡當月已發給的待遇不追繳。

志願役現役軍人的俸級分為多種職級，並依附表所列俸點折算俸額發給；俸點折算俸額的數額由行政院定，必要時可按俸點分段訂定。

This article lists seven types of allowances and sets a monthly NT$30,000 amount for volunteer-service allowance, with other allowance amounts to be set by the Executive Yuan.

國防部負責擬訂義務役現役軍人薪額月支數額，並報請行政院核定；其待遇總額不得低於最低工資法所定的最低工資。

志願役現役軍官、士官及士兵，自生效日起按核定官階（等級）俸級支給；轉任較高官階時，依原支俸級換敘，必要時可保留原支俸點。

Salary-grade seniority is counted toward promotion, which takes effect on the first day of the following month after one year is completed; leave without pay time is not counted.

Certain military personnel may have their earlier service years counted together when advancing pay grade.
