陸海空軍軍官服役條例

本條是依兵役法第三條制定的。

This provision classifies reserve service into first, second, and third reserve categories based on years of active service and related age or service-combination thresholds.

常備軍官預備役在臨時召集或動員召集時，依專長、年齡與體格，按預備役序次辦理；平時的臨時召集服現役時間要補足現役年限，教育、勤務、點閱等召集則依兵役法及其施行法。

現役常備軍官在列明情形之一時，應予停役；停役原因消滅後，得依情節回役或免予回役。

現役中的常備軍官，只要符合列舉情形之一，就會被退伍。

常備軍官預備役人員在依志願或應召再服現役期滿，或符合第十二條、第十三條所列情形之一時，將予以解除召集。

常備軍官在服役期間，符合列明情形之一時，要予以除役；第三款除役人員歸還時，未達服役限齡者，得視情節及軍事需要回復現役或轉服預備役。

常備軍官在服役期滿時，遇到列舉情形之一，可以延役；延役到戰爭結束後六個月為止，延役期滿或原因消失時，則退伍、解除召集或除役。

預備軍官自起役日起，依規定服預備役，並可依志願服現役。

預備軍官在現役期間的停役、回役，原則上依第十二條辦理；但在臨時召集服現役期間，如因病六個月未癒，得予停役，病癒即回役。

預備軍官在退伍、解除召集、除役、延役等事項上，適用與常備軍官相同的有關規定。

軍官服役，依本條例規定；本條例未規定的，適用其他法律。

預備軍官在依第八條轉服常備軍官役後，其服役一律依常備軍官的規定辦理。

軍官退伍時的給與依服現役年資決定：未滿3年不發退伍金；逾3年未逾20年者，按現役實職年資給與退伍金；逾20年，或滿15年且年滿60歲者，得按年資領終身退休俸，或依志願改領第二款退伍金。

Certain officers transferred to reserve service after specified discharge categories are subject to Article 21 benefit rules. Officers discharged under item 2 who qualify for support may, on a voluntary basis, receive lifelong maintenance allowance, and the Executive Yuan sets the implementing rules.

已領退伍金或退休俸的預備役軍官，若應召或依志願再服現役，於解除召集時，退伍金或退休俸依本條規定重新計算或增加給與。

符合條件的現役軍官，其退伍金、退休俸或贍養金金額得酌予增加。

軍官在現役期間若受撤職處分或被判處有期徒刑以上之刑，因而退伍或除役，則不發退伍金、退休俸或贍養金。

軍官在領退休俸或贍養金期間，如出現列舉情形之一，退休俸或贍養金會停發。

退伍金、退休俸、贍養金的給與規定，依附表辦理。

Women volunteering for commissioned-officer service are generally subject to the other provisions of the ordinance, except for the listed special rules.

軍官經考送國外留學時，可以延長服現役年限，但延長時間最多不得超過四年。

Regular officers begin service on appointment, and reserve officers begin service when their qualification certificate is issued. The provision also divides service into active service and reserve service, and states when each category ends.

軍官擔任非軍事機關或學校的軍事性職務時，其年資照算。

符合條件的常備軍官，其服役年限可依軍事需要延長；在特定修正前已考入軍官學校者，畢業任常備軍官後現役年限為10年，期滿後原則上不適用第9條延長服役規定，除非志願並經核准續服現役。

服軍官役者必須宣誓效忠中華民國，遵守軍中法令，並終身保守公務機密。

本條例的施行細則由行政院訂定。

This provision says the ordinance takes effect on the date it is published.

軍官的服役限齡依階級不同而不同。

軍官依軍階有服現役最長年限；自任官日起算，將官在本階內為十年。

符合條件的適齡男子，以及現役或後備士官、士兵，在依志願考取軍官學校並完成常備軍官教育、期滿合格後，服常備軍官役。

Certain volunteer-qualified persons must undergo reserve officer education and service; item 5 persons must serve active duty for a period; item 6 persons may directly serve reserve officer duty.

Preliminary military officers with good performance may, when military needs require, volunteer to transfer into active-duty officer service.

常備軍官的現役年限是十年；期滿後，除志願留營者外，得因軍事需要延長服役三年至五年。志願考入軍官學校正期班並畢業任軍官者，不受前項年限限制。
