志願士兵服役條例

本條是說：本條例是依兵役法第四十七條第二項制定的。

This provision sets how volunteer soldiers are evaluated, including year-end performance reviews, separate reviews for certain shorter service periods, and a rule that no evaluation is done if service was interrupted for more than six months.

If a volunteer soldier becomes disabled or dies during service, pension and compensation matters are handled under the military pensions rules, and the compensation base is calculated using the soldier benefit standard in those rules.

志願士兵的保險，依軍人保險條例及其相關規定辦理。

志願士兵的請假事項，依常備士官請假相關規定辦理。

適齡女子若志願服軍事輔助勤務，依其志願辦理。

This provision says the statute takes effect on the date it is promulgated, and the effective date for the amended provisions from 24 December 2021 is set by the Executive Yuan.

志願士兵服役依本條例規定；本條例未規定的部分，適用兵役法及其施行法中關於常備兵役的規定。

Certain people may apply to become volunteer soldiers if they want to, meet the basic training requirement, and pass selection; mainland China, Hong Kong, and Macao residents must have household registration in Taiwan for 20 years before they may apply.

前條第一項各款人員服志願士兵，自國防部核定之日起役；國防部也可以委任或委託其他機關辦理核定，受委託機關核定時要副知國防部及所屬司令部。

This provision sets minimum time in grade for volunteer soldiers and the maximum active-duty period for sergeants, and excludes leave-without-pay periods from those calculations.

志願士兵服役期滿原則上應退伍；在戰時、非常事變，或同時退伍人數影響國防安全時，國防部可以命令其繼續留營服役或分期退伍。

符合特定考績、懲罰或不適服條件的志願士兵，國防部或各司令部須在三個月內依規定處理，並可能涉及轉服、退伍、解除召集或賠償。

志願士兵在現役期間，符合特定疾病、傷病、體質衰弱或身心障礙情形時，會被退伍、除役或停役；停役原因消滅後，依情節與軍事需要，可能回役或免予回役，免予回役者則退伍。

志願士兵現役期間原則上不得少於四年；國防部可因軍事需要在甄選時明定，且符合特定例外者不受此限。期滿後如申請繼續留營，國防部得核定續服，每期通常以一年為單位，最長三年。

志願士兵符合特定情形時，可以申請留職停薪；國防部原則上辦理，但第一款不得拒絕。

志願士兵的退除給與，原則上應在退伍或除役時發給；未領退除給與而轉任公職者，得依其志願把軍職年資併計公職年資辦理退休。

政府和現役人員共同提撥費用設立基金，用於支付志願士兵退除給與與撫卹金；符合條件者可申請退還已繳基金費用並加計利息，基礎訓練期間的年資也可合併計算。

志願士兵退除給與以退伍除役生效日現役同等級人員本俸加一倍計算；若本俸未達下士一級標準，改按該標準計算，差額由政府預算支付。
