要塞堡壘地帶法

This provision defines “要塞堡壘” and “要塞堡壘地帶” for military-defense purposes.

違反前列條款者，最重可處五年以下有期徒刑；如果是過失犯，則可處十月以下有期徒刑、拘役或三百元以下罰金。

國防部可以另行訂定違反第七條第三款或第六款時的懲罰辦法。

Violating the specified rules can lead to imprisonment, detention, or a fine; negligent violation carries a lighter penalty.

If a person violates the cited provisions, the listed tools, film, drafts, and aircraft may be confiscated.

Anyone who damages or moves signs installed in a fortress/fortified area can be punished with up to one year’s imprisonment, detention, or a fine of up to 300 yuan.

違反前述規定的人，會被處以10萬到50萬元罰鍰，並被命令限期改善；逾期未改善的，還可能按日連續處罰。

Before a planned fort or castle is built, the rules of this Act may also be announced as applicable in that area.

國防部得視情形，在某區域內解除或暫緩全部或一部分本法所禁止及限制事項，但必須在顯著地點公告，之後有變更時也同樣要公告。

戰時要塞司令在必要時，可以在要塞地帶內命令除去建築、堆積物和種植物。

The Ministry of National Defense determines, by order, which forts and fortresses fall under this Act.

This provision says the Act takes effect on the date it is promulgated.

This provision defines the extent of a fortress/bastion zone as the area within a specified outward distance from certain bases or baselines.

This provision divides a fortified area into zones and gives the Ministry of National Defense power to set and publish the no-fly and restricted-flight limits.

本條限制第一區內的進入、居住、特定活動與部分設施，並授權要塞司令在一定條件下加以禁止、拘留、偵訊或勒令遷出。

In the second area, the listed surveying, imaging, drawing, describing, and military-reconnaissance activities are prohibited unless the fortress commander gives permission; similar permission is also required for certain construction, ground-level changes, and material-height limits.

本條限制第一、第二兩區內的出入、攜帶物品、外國船舶通行停泊，以及特定工程的新設或變更，部分事項須先取得指定機關許可。

外國航空器、本國民用航空器及本國軍用航空器，未經指定機關特許或許可，不得飛越禁航區域或限航區域；在天候惡劣或夜間使用儀器飛行時，限航區域的飛越可獲准。

軍用飛機場周邊一定距離內，主管機關要採取措施防止飛鴿、鳥類和牲畜侵入；國防部可會同相關機關劃定並公告該距離範圍。

軍用港口限制區內禁止採藻、繫泊、漁獵及養殖；商（漁）船、漂浮器、人員及外國籍軍艦等，未經國防部同意不得進入軍用港區與限制水域。

If someone violates the prohibited or restricted matters in this law, the fortress command must order demolition or restoration, and may carry out the work itself or use a third party if the deadline is not met or the method is unsuitable.

A person who violates Article 4(1) or Article 5(1) faces imprisonment of 1 to 7 years; a negligent violation is punished by up to 1 year imprisonment, detention, or a fine up to 500 yuan.
