戒嚴法

總統在戰爭、叛亂或緊急情勢下可以依本法宣告戒嚴，但要符合行政院與立法院相關程序，緊急情形下還要在期限內送立法院追認。

Judgments under Articles 8 and 9 may be appealed according to law starting the day after martial law is lifted.

戒嚴地域內，最高司令官可以對集會、宗教活動、罷工罷課、通信、交通、旅客、危險物品、建築物、遷入遷出、不動產及可供軍用的民間物資，採取檢查、限制、禁止、扣留、沒收、解散、破壞等措施。

When martial law ends, or when the legislature resolves to request the President to lift it, the President must declare the lifting of martial law immediately.

This law takes effect on the date it is promulgated.

本條定義「警戒地域」與「接戰地域」，並規定在必要時應將這些地域區劃並布告。

在戰爭、叛亂或其他非常事變下，當地最高司令官可依本法宣告臨時戒嚴；若當地沒有最高司令官，則可由陸海空軍分駐團長以上部隊長宣告戒嚴。

When martial law is declared, the area’s highest commander must promptly report the situation and all measures up the chain to the President.

The area under declared martial law may be changed when necessary, and specified provisions apply to that change.

在戒嚴期間，警戒地域內的地方行政官和司法官，辦理軍事事務時要受當地最高司令官指揮。

在戒嚴時期，接戰地域內的地方行政事務和司法事務由該地最高司令官掌管；地方行政官和司法官應受其指揮。

戒嚴時期在接戰地域或警戒地域內，軍事機關可以自行審判或移送法院審判本條列出的若干罪名及相關特別刑法罪。

In martial-law periods, if a combat area has no court or communication with the competent court is cut off, the local military authority may try civil and criminal cases.
