全民防衛動員準備法

This provision states that the Act is enacted to build a civilian defense mobilization system, promote the idea of total national defense, carry out mobilization preparation, and protect people’s rights.

Each competent authority for a mobilization preparation plan must establish a mobilization preparation business meeting.

行政院得指定所屬機關為動員準備分類計畫主管機關；各主管機關並應指定單位及專責人員辦理動員準備業務，且接受上級方案主管機關的建議。

直轄市、縣（市）政府應設動員準備業務會報，並按規定推動相關任務與定期開會。

在動員準備階段，相關主管機關及直轄市、縣（市）政府應對可動員的人力、物力、科技、設施及交通輸具進行調查、統計與規劃，並可以實施演習驗證。

This provision requires government bodies to promote all-out national defense education, include it in local policy and publicity, and set rules for school curriculum and mobilization-stage media controls.

主管機關在動員準備階段要調查、統計、編組相關民間人力並規劃配套；地方政府與相關事業機構要配合，國防部還要訂定軍事人力統籌分配辦法。

This provision requires the mobilization planning authority, local governments, state and private producers, the Ministry of Economic Affairs, and the Ministry of National Defense to carry out supply-preparedness, reporting, storage, emergency-response, and requisition/compensation planning tasks.

國防部要結合相關生產事業建立國防工業動員生產體系，並可視需要選定工廠、簽訂生產轉換契約及訂定作業規範；訂約工廠也要配合參加演習。

主管機關應就動員實施階段的戰費籌措、預算轉換及金融外匯管制事項作出規劃，以穩定財政金融秩序並調度所需資金。

本條要求相關機關為動員實施階段預先規劃運輸與港埠、船舶、民航及搶修等準備；船舶所有人要配合船舶艤裝事項。

This provision defines two mobilization stages: a preparation stage during ordinary times, and an implementation stage when war or emergency danger occurs and the President issues an emergency order to carry out national or local mobilization.

主管機關要定期調查、統計並校正車輛等動員能量資料；相關所有人或管理人也要配合並提供資料。

主管機關要編組與訓練後備部隊，並設置後備軍人輔導組織；相關機關要全力支援軍事動員需求並配合演習。

主管機關得要求相關機關實施必要演習，必要時也可指定公私營產業參與；被指定的產業以及直轄市、縣（市）政府應配合。

國防部或其他依法成立之武裝團隊主管機關可以在一定範圍內設立永久或暫時性的演習區域，並進行演習與訓練；設立後要會同內政部公告並通知相關機關。

主辦演習機關在演習需要時可以徵購、徵用人民財物和人員；徵用時應給予相當補償，且實施前要先報請行政院動員會報核准。

Certain property may not be purchased or expropriated.

This provision lists mobilization tasks for preparing resources and supporting disaster relief, military operations, emergency response, and basic civilian needs.

主辦演習機關在實施徵購或徵用時，要發出徵購、徵用書，並命令財物所有人或管理人交付財物；演習單位收受財物後要立即開立受領證明。

徵購或徵用財物的計價或補償，應由相關機關、地方政府、所有人或管理人及相關同業公會，參照市價和使用情形來評定。

When the reason for requisition ends, the organizing exercise agency must immediately cancel the requisition and return the requisitioned property to the original owner or manager at the original delivery location.

主辦演習機關必須修復在徵用期間受損的受徵用財物；不能修復或已毀壞、滅失時，應解除徵用並給予補償金。

動員演習機關可以徵用必要的民力，但要在報到日前10天以書面通知；被徵用的人要依時到指定地點報到。

主辦演習機關可按實際需要提供膳宿、交通工具或改發代金；參加演習期間，參與人員的服務機關、學校、團體、公司或工廠應給予公假。

受徵用而受傷、失能或死亡的人，原則上依其本職身分規定請領給付；不能依前項請領時，改由主辦機關負擔醫療費用、發給失能給付或撫卹金，並在金額不足時補足差額。

本條規定遺族請領撫卹金的順序，並規定同一順位有人數時要平均請領。

各項給付的請領權，從可以行使之日起算，兩年內不行使就消滅；但如果本職身分或其他法律另有規定，則依該規定。

國防部會同有關機關擬訂演習時財物徵購、徵用、補償及解除徵用的辦法，並報請行政院核定發布。

中央各機關及直轄市、縣（市）政府應把動員準備事項納入年度施政計畫並推動實施。

國防部負責訂定動員準備事務的獎勵及慰勞辦法。

A person who violates certain listed provisions without justifiable reason may be fined up to NTD 3 million.

無正當理由違反指定條文、經限期仍不辦理者，會被處新臺幣3萬元以上15萬元以下罰鍰，且可按次處罰。

Without a justifiable reason, a person who violates Article 34(2) is fined NT$20,000 to NT$100,000.

If a fine under this Act is ordered to be paid within a set period and is not paid by the deadline, it is referred for compulsory enforcement according to law.

Government agencies must handle mobilization-preparation expenses through the budget process. When municipal and county/city governments assist with investigations or exercises under this Act, the relevant expenses are budgeted by the competent authority for the commissioned mobilization-preparation plan.

執行動員準備業務的人員，對於因職務上知悉或持有的國家機密或他人營業秘密，負有保密義務。

本法的施行細則由國防部訂定。
