軍事教育條例

This provision says the statute is enacted to strengthen military education, train military talent, and build national defense, and that any matters not covered here follow other laws.

軍事學校可以設置各處、中心、室，並可分科或組辦事；因教學、研究或推廣需要時，還可報請國防部核定設置特定單位。

相關軍事學校單位各設一名主管；其任職條件由國防部訂定。

軍事學校應設置學生指揮部或學員總隊部，負責學員生活管理及其他事務；其任職條件由國防部訂定。

軍事學校教師的任用資格依教育人員任用條例辦理；基礎教育學校的文職教師比例不得低於三分之一；軍事學校教官的任職條件由國防部訂定。

軍事學校文職教師的權利義務，依相關教育法律辦理；具現役軍人身分的教師，其資格檢定、審查與待遇等，適用教師法第2章與第5章。

Military schools may admit self-funded students, and the rules for their rights, duties, and management are set by the Ministry of National Defense together with the Ministry of Education.

The Ministry of National Defense may set up preparatory schools, and the schools must handle administration under education laws and report student records to the local competent education authority.

軍事學校及預備學校的學員生，除自費學生外，享有公費待遇及津貼。相關發給辦法由國防部擬訂，並報請行政院核定。

領受公費待遇及津貼的學員生，若違反應履行義務或應遵行事項，應負賠償責任。

各軍事學校與預備學校都要先擬訂其組織規程，再報請主管機關核定。

軍事教育屬於國家整體教育的一部分；國防部是主管機關，並依相關教育法律接受教育部指導。

國防部得視需要辦理大學儲備軍官訓練團；相關甄選、訓練、公費發給、退訓、管理及服役的實施辦法，由國防部會同教育部、內政部訂定。

國防部應推動終身教育，以提升全體官兵素質，並由國防部訂定相關辦法。

國防部得設置基金；基金收支、保管及運用應由管理委員會管理、經費稽核委員會監督，相關辦法由國防部報請行政院核定。

國防部可以協調專科以上學校，在營區內開設學位在職專班，且不受部分公開名額與方式限制。

各軍事基礎院校應接受教育部辦理的大學評鑑。

本條例自公布之日起施行。

Military education is divided into officer education and non-commissioned officer education, and the military training stages are basic education, advanced education, and further education.

國防部辦理軍事教育時，可以透過軍事學校授予學位、發給畢業證書，或由軍事學校、軍事訓練機構發給軍事學資證明。

本條規定軍事學校或軍事訓練機構辦理基礎教育的類別、宗旨，以及招生和學生事項的規則制定方式。

本條規定現職國軍軍官及士官的進修教育，並授權國防部訂定相關班別設立、課程標準、學員資格、修業期限及軍事學資授予事項。

This provision says military graduate education is meant to train national defense leadership talent, and the Ministry of National Defense sets standards for certain programs; for research institutes, it sets standards together with the Ministry of Education.

軍事學校應設校長1人；也可以再設副校長、教育長、政戰主任各1人。這些職務的任職條件、任期和任免方式，由國防部訂定。

軍事學校可設院長、系主任、所長、部主任或科主任；其中部分職務須先遴選、報請權責機關核定後，再由校長聘兼。
