殺傷性地雷管制條例

本條文說明制定本條例的目的，並表示本條例未規定的事項，適用其他法律。

因政府使用或剷除殺傷性地雷造成傷亡或財物損害時，人民可以向主管機關申請補償；補償辦法由主管機關訂定。

本條例自公布日開始施行。

This provision states that the competent authority under this statute is the Ministry of National Defense.

This provision defines three terms: “anti-personnel mine,” “minefield area,” and “transfer.”

未經主管機關許可，不得研發、生產、使用、儲存、移交殺傷性地雷，也不得協助、鼓勵或唆使他人這樣做。

主管機關在非因戰爭迫切需要時，不得使用殺傷性地雷。

主管機關要公告佈雷區域，並在區域內的殺傷性地雷應於七年內完成剷除；必要時還要依程序報請展期並每年報告。

主管機關為達成本條例目的，應實施監督與控制措施，並定期檢討、協調、改進相關法規及其執行情形。

主管機關得基於平等互惠原則，向其他國家尋求協助，以處理銷燬或剷除殺傷性地雷相關事項。

Violating Article 4 can lead to at least 7 years’ imprisonment, an additional fine of NT$500,000 or more, confiscation of related equipment and materials, and punishment for attempted offenses.
