軍事營區安全維護條例

This provision states the purpose of the statute: to protect military camp security and ensure the carrying out of military exercises, training, and readiness missions.

軍事營區安全勤務人員在特定情形下可以使用器械，必要時可以使用武器；衛哨兵在部分情形使用武器時，應依命令執行。

前條人員使用武器時，原則上要先警告；使用武器或器械時要合理、不得過度，避免非急迫時傷及致命部位，原因消失要立刻停止，並不得傷及第三人。

主管機關應成立調查小組；該小組可就軍事機關相關武器或器械致死、重傷爭議事件進行調查並提供意見。

指揮官、值勤軍官、士官及衛哨兵在使用武器或器械造成現場人員傷亡時，應迅速通報救護或送醫，並採取必要的保護或戒護措施。

接獲通報後，前條人員所屬軍事機關應進行調查，並提供該人員涉訟輔助及諮商輔導。

People and third parties may claim compensation from the relevant military agency for special losses caused by specified security actions or weapons use, subject to fault-based reduction/exemption and a 2-year claim period.

If commanders, duty officers, non-commissioned officers, or sentries use weapons or equipment in violation of this provision while carrying out military camp security duties and cause harm to people’s freedom or rights, the matter is handled under the State Compensation Law.

Harming the normal function of important military facilities by theft, destruction, or other unlawful means is punishable by imprisonment and possibly a fine; heavier penalties apply if done with intent to harm national or military security, if it causes disaster, death, or serious injury, and attempted offences are also punished.

It is a crime to harm the normal operation of core information systems of important military facilities, including unauthorized intrusion, interference, or altering electronic records. Making or supplying a program for that offense is also covered.

未經軍事機關許可，不得在軍事營區內進行測量、錄影、攝影、描繪、記述或其他偵察行為；違反者，最重可處三年以下有期徒刑。

本條例的主管機關是國防部。

Threatening military camp security guards or duty officers/NCOs with harm to life, body, freedom, reputation, or property is punishable by up to 2 years’ imprisonment, detention, or a fine.

未經許可進入軍事營區的人，可能會被警告或處以罰鍰，並會被命令立即離開。

符合列舉情形者，會被處新臺幣三萬元以上十五萬元以下罰鍰。

If a person enters a military camp without permission while carrying prohibited items and refuses a warning to hand them over for safekeeping, the entry permit is revoked and a fine of NT$10,000 to NT$50,000 may be imposed.

在軍事營區外執行警戒、管制或其他必要安全勤務的人員，原則上準用第10條至第16條；但法律另有規定者除外。

本條例的施行日期由行政院決定。

This article defines key terms used in the statute and gives the competent authority power to announce or determine certain categories and rules.

軍事機關得在軍事營區的重要處所設置衛哨所、配置衛哨兵，並得在必要範圍內裝設監視、警報或阻絕等安全防護設施。

Military camp security duty is directed by commanders or their authorized personnel, and duty officers or NCOs supervise sentries. Those performing the duty may carry weapons, tools, or equipment while carrying it out.

未經軍事機關許可，不得進入軍事營區或對其進行特定行為。

衛哨兵可對進出軍事營區的人或物做安全檢查；拒絕檢查或不符合管理規定者，應被拒絕進入，必要時可強制驅離。

軍事機關人員在符合特定危險情形時，得對軍事營區內的人實施安全管束，並得檢查其身體與攜帶物；管束原則上應立即報告指揮官、安置或通知適當親屬或機關，危險 समाप्त後即停止，最長不得超過 24 小時，但軍用艦艇航行中特定情形有例外。

A person may object on the spot to certain military security checks, removal measures, or camp security control measures, unless another law provides otherwise.
