國防工業發展基金設置條例

This article creates the National Defense Industry Development Fund and states that the statute is enacted to promote the overall development of defense-related industries.

本基金的會計年度要與政府會計年度一致；預算、決算與相關報告要依指定程序編製、審核、報送與公開。

本基金董、監事會在情勢變更或設置目的已完成時，可以解散本基金。

本條例自公布日起施行。

本基金設董事會，由董事會負責基金的保管、審議和運用。

本基金董事會應設董事九至十五人，其中一人為董事長；董事由行政院院長聘任，國防部部長與經濟部部長是當然董事。

本基金設三名監事；行政院主計長是當然監事，其中一人任監事會主席，並由行政院院長聘任。監事會主席應列席董事會議。

本基金的主管機關是行政院。

本基金董事會可以因業務需要配置若干工作人員；其組織編制經董事會通過後，須報請行政院核定。

董事會應依本條例及相關法律擬訂本基金捐助章程，並報請行政院核定。
