戰時軍律

During wartime, this military law applies to soldiers, local team personnel, and civil servants who also hold military posts if they commit an offence under that law.

在同一戰線或戰場、負同一任務時，若坐視友軍危殆而不策應赴援，將受死刑、無期徒刑或十年以上有期徒刑。

無故擅離部屬者，處七年以上有期徒刑；如果因此發生事變或貽誤軍機，處死刑。

A person who fails to perform a required duty and causes military supplies to be unavailable on time faces at least 7 years’ imprisonment; if that offense then causes military matters to be compromised, the penalty is death or life imprisonment.

未盡應盡責任而遺棄傷病官兵者，處七年以上有期徒刑。

政治工作人員有責任檢舉並監察軍人或地方團隊人員違反本軍律的執行；在作戰區域遇有本軍律專科死刑現行犯時，軍事最高機關可以緊急處置並補呈卷判；若日後發現證據不符或有重大錯誤，相關軍事長官與承辦人員應依法治罪。

This provision says the military law takes effect on the date it is promulgated.

有守土之責的人，未奉命令而擅自棄守的，處死刑。

臨陣退卻或託故不進的人，會被處死刑。

在敵前反抗命令或不聽指揮的人，處死刑。

投降敵人或叛徒者處死刑；該罪的未遂犯也要處罰；預備或陰謀犯第一項之罪者，處死刑、無期徒刑或十年以上有期徒刑。

主謀、要挾或指示從事對軍事不利之叛亂行為者，處死刑。

Enemy-fleeing persons are punishable by death.

Stealing or damaging military-related transport or communications equipment is punishable by at least 10 years’ imprisonment; if it makes the equipment unusable, the penalty is death or life imprisonment. Attempted offences are also punished.

Anyone who commits one of the listed combat-related acts faces life imprisonment or at least ten years’ imprisonment; if the act causes disclosure of military secrets, the penalty is death.
