妨害軍機治罪條例

This provision defines “軍機” as information, documents, pictures, or items that must be kept secret for military reasons, and gives the Ministry of National Defense power to set the scope by order.

現役軍人犯本條例之罪，由軍事審判機關審判；非現役軍人由司法機關審判。但若在戰地或戒嚴地域犯之，不論身分，都由軍事審判機關審判。

If this Act does not provide a rule, other laws apply.

This provision says the regulation takes effect on the date it is promulgated.

This provision criminalizes leaking, delivering, or disclosing military secrets and sets severe penalties, including death, life imprisonment, and long prison terms.

Leaking, delivering, or publishing military secrets obtained through spying or collection is punishable by death, life imprisonment, or imprisonment over ten years; doing so to a foreign state or its agents is punishable by death or life imprisonment; preparation or conspiracy is punishable by three to ten years’ imprisonment.

Anyone who accidentally learns or possesses military secrets and leaks, delivers, or makes them public faces imprisonment; harsher penalties apply if the recipient is a foreign state or its agents, and negligent commission of the first two offences is also punishable.

刺探、竊取或隱匿非職務上應知悉或持有的軍機者，最高可處五年以下有期徒刑。

Anyone who enters or stays in specified defense-related places without permission, or who secretly carries firearms/explosives and forcibly or unlawfully enters them, is subject to imprisonment.

A person who enters the specified area, place, or building without permission or by fraud and then measures, photographs, sketches, describes its contents, or observes the weather commits an offence punishable by 1 to 7 years’ imprisonment.

This provision says attempted offences covered by the listed paragraphs/articles are punished.
