About this statute

A ship carrying absolutely prohibited or conditionally prohibited goods to a prohibited area or prohibited recipient may be recognized as such under the listed criteria. A ship’s cargo or route record is treated as invalid if it is not actually headed to a prohibited area or prohibited destination, but it has left its planned route and cannot give a sufficient reason for the change; the same applies if there is other sufficient evidence that it is headed to a prohibited area or destination. If goods are unloaded at a neutral port that regularly transships supplies for an enemy state, that conduct is treated as transporting to a prohibited area or prohibited target. If conditional contraband has been requisitioned or rationed by an enemy government, intending to send it to the prohibited area in Article 7 is treated as conduct of sending it to the prohibited area or prohibited object in Article 8. If the import of conditional prohibited goods into a neutral country has risen significantly compared with the average of the three prewar years, and there is intent to send those goods to that neutral country, the conduct is treated as transporting to an embargoed area or embargo target.
