戰士授田憑據處理條例

This provision states that, after the former veterans land allocation law and its implementing rules were repealed, this law is made to recover soldiers’ land-allotment certificates.

符合條件的退除役無職軍官，會被視為已發給授田憑據，並依本條例處理；但因叛國或逃亡而被判有期徒刑以上者除外。

The Executive Yuan determines the enforcement rules and effective date for this statute.

持有戰士授田憑據的人，應依規定申請登記領取補償金；領到補償金後，要收回憑據且不再授田。

戰士授田憑據的補償金按每份發給1至10個基數，每個基數是新臺幣5萬元；補償金總額不得超過新臺幣880億元，且相關經費要編列特別預算，發給的補償金免納所得稅。

符合條件並提出登記申請的人，補償金要在法定期限內一次發給。

Eligible veterans’ compensation is paid once, either within six months after the statute has been in force for six months, or within three months after registration if the registration is made more than one year after the statute takes effect.

People holding a veteran land grant certificate, except those under Articles 4 and 5, may apply for compensation money; the payment is made once within the stated deadlines.

未在通知領取後二年內領取的補償金，由政府專戶保管；逾五年未領取的，補償金歸屬國庫。

第二條第一項及第二項人員如果在領取補償金前喪失中華民國國籍，就不得領取補償金。

戰士之家屬申請登記發給或領受補償金的順序，依民法第1138條規定。
