國軍老舊眷村改建條例

This provision states the purpose of the law: to renew old military dependents' villages, improve land-use efficiency, build housing for specified groups, preserve village culture, help local governments obtain land for public facilities, and improve the urban landscape.

改建基金可用國有不適用營地處理所得款項，按特別預算程序作眷村改建周轉，並在適當時機繳回國庫。

Certain land may be handled in specified ways unless the authority chooses to rebuild it itself; for cultural-preservation military-village land, the Ministry of National Defense must transfer the land and buildings to the local government without compensation.

Most land covered by Article 4(2) must be priced by special-case appraisal, except specified categories that are priced using the announced land value at the time the house is completed.

This provision lists the sources of funding for the redevelopment fund.

改建基金只能用在列出的改建、搬遷、補助、融資利息、文化保存及其他相關支出；其中眷村文化保存支出只限於開辦用的軟硬體設施。

改建基金經管的眷村土地，經改建經營處理後的盈收，應作為照顧低收入家庭居住的資金；其辦法由行政院另定。

住宅社區配售給原眷戶時，原則上每戶限配售一戶；配售坪型依原眷戶現任或退伍時職缺編階辦理，零星餘戶由主管機關處理，相關辦法也由主管機關訂定。

依本條例興建的住宅社區，可在需要時依都市計畫法規設置商業、服務設施及其他建築物，並可連同土地一起標售。

If old military dependent village land is public facility land, the municipal or county government must coordinate with the village reconstruction plan and give demolition compensation priority.

Certain old military dependent villages or non-applicable camps may be exchanged or divided for overall planning, with both parties’ agreement and approval by the superior authority, and the Land Act articles listed do not apply.

本條例的主管機關是國防部；國防部長應邀集相關部會代表成立推行委員會，負責協調推動國軍老舊眷村改建。

本條規定原眷戶的輔助購宅款、應自行負擔金額、補償與退款方式，以及主管機關的書面說明義務。

原眷戶放棄承購改建住宅並自願領取前條輔助購宅款後搬遷的，依其意願辦理。

在依第二十二條規劃改建的眷村中，原眷戶同意改建達三分之二以上，且屬身心障礙或貧病等特殊需要並依第二十一條自願領取輔助購宅款者，主管機關得發給該款項。

This provision sets consent thresholds and procedures for renovating veterans’ housing villages, and gives the competent authority powers to cancel rights and recover property in some cases.

符合條件的眷戶，收到主管機關書面通知後，須在6個月內配合騰空並點還房地；完成後可依地方拆遷補償標準獲補償，且補償有上限，並可價購或承租一定坪數以下的零星餘戶。

主管機關應對符合條件的違占建戶辦理補償後拆遷，並可協調提供優惠貸款；逾期未搬遷者，主管機關可收回土地並移送法院強制執行。

主管機關配售的住宅，承購人自產權登記日起未滿5年，除依法繼承外，不得自行出售、出典、贈與或交換。

主管機關配售的住宅可免徵不動產買賣契稅；在建築完工後、產權尚未完成移轉登記前，也免徵房屋稅及地價稅。

軍眷住宅的使用人如果不是原眷戶但持有房屋所有權狀，應比照原眷戶規定辦理。

地方政府在辦理國軍老舊眷村土地改建時，土地計價、規劃設計、配售標準及租稅減免等，應依本條例辦理。

本條規定，已完成改建、或已報行政院核定改建的眷村，原則上依國防部原規定辦理；其中部分土地的計價方式，依是否原地改建、空置或分期規劃、以及是否一次繳清而有不同標準。

主管機關有權訂定本條例的施行細則。

本條定義「國軍老舊眷村」與「原眷戶」。

This provision says the regulation takes effect on the date it is promulgated.

主管機關要把相關土地和營地名稱、位置列冊報行政院核定；也可以在特定目的下運用相關國有土地。

原眷戶有權承購本條例興建的住宅及政府補助購宅款；其死亡後，配偶優先承受權益，配偶也死亡時由子女承受。

主管機關辦理國軍老舊眷村改建時，應依眷村分布與相近條件整體分區規劃，並以既有眷村土地、不適用營地或價購土地辦理，變更為適當分區或用地後集中興建住宅社區。

Land in an urban planning area that is not residential and is not a campsite may, if local urban development is not harmed, be changed to residential use and then rebuilt under this statute. Land outside an urban planning area is to be changed into building land under the relevant laws.

政府 must establish the old military villages reconstruction fund, and the Executive Yuan sets the rules for how it is managed and used.

本條文要求符合條件的各級地方政府在施行後六個月內擬定計畫並執行國軍老舊眷村改建；逾期未擬定時，除公共設施用地外，應將土地讓售主管機關。
